    Even then, youre not the landowners of the common spaces, theyre still under lease. You would need to vary the leases again, or obtain a 75% vote.

    The catch all cannot derogate from teh grant, at whcih point you are having to prove your scheme to start requiruing people to park on land the part own somehow doesnt derogate from grant. Good luck.

    Yes, its how they operate. There wwre cases on here where someone on a shared car aprk set up and ticketed anyone they didnt like, on the entire car park and not just the bit that was their space.

    But that was not someone from completely outside the estate which is what I am talking about. I agree what they did was wrong but that doesn't mean that is the way it does work. The person would perhaps have had access to a "communal" app but then stretched it too far!

    In terms of our estate I don't agree with you about regulating parking on our road but I think that's my fault as I am not explaining it very well. We do have a catch all as I said

    I would love to see a catch all that can prevent such use, and require a resident to contract with a third party. Its unlikely to fly. Land vs contract tends to fall heavily on Land.

    Yes. So when they say "this is my land", what do you think the PPC do? Ask for proof? Youre kidding, right?

    anything can happen and it's certainly very possible for
    a Norris to act.

    There was a thread not long ago where a resident was
    ticketed at 1am in the morning a few times

    We are talking about self ticketing here - not wardens

    Re the 1 am - yep remember the thread. That was undoubtedly a p""""d off resident of the estate. Not someone from outside who happened to be passing and decided to go into the car park to take a picture of a random car to load on to his app. I'd guess the residents had the app or the upload facility and this person was one of the "authorised users". Their very own Norris!

    Sign up with an App or the PPC gives them a camera,
    does not matter ..... There will always be a Norris looking
    for income and as we have all said .... it happens

    Mr PPC does not care how their income comes in

    Nobody said that but it could happen, if a passer by saw the
    opportunity ...... the PPC would take them on

    Hi. I have received a ticket from Smart Parking as I was 1 minute over my ticket, exiting the car park according to their cameras. I still have my parking ticket showing until 14:48, and their picture shows I left at 14:49.

    So. The person sets up themselves on the app without any proof of landowner authority etc etc. They then go round town going on to private land taking pictures of "illegally" parked cars which have to be with that particular PPC and upload them

    How do they know it is a self ticketing area. Does it say that on the signs?

    Have you got a link to a real case where someone from completely outside an estate/business has done this please without landowner authority?

  • There was a thread on Mumsnet recently where the poster was parking on unused land which was actually owned by the owners of 3, 5 and 7 Acacia Avenue (for the sake of argument). Another resident (not owner of 3, 5 and 7 and therefore with as much right to park there as the poster, ie none) wanted to park there. Although there was room for both of them, the other person didn't want the poster to park there. So she registered herself with one of the parking companies as a self ticketer, bunged up a sign and started issuing tickets. The PPC carried out no checks at all, and required no evidence at all, of ownership. Slightly different as not an estate, but shows that the PPCs do not require evidence of ownership/authority.

    I think that this is a very useful discussion because anyone considering buying a property with an allocated parking space needs to be aware of the potential issues. As land become scarcer there will be more properties with allocated spaces rather than drives and garages.
