Ok, so the court date was today at 10am. I arrived nice and early at 9:30 and went to check in. My case was not on the list for the day, after a few calls were made they said the case has been vacated!
Obviously this is great news for me, but I have costs I wanted to claim. Are these still worth pursuing or should I cut and run?
I’d like to take the opportunity to thank everyone who has taken the time to help me prepare for this, there’s no way I could have fought this on my own0 -
Who vacated it?
The court or the claimant?
IF the claimant, then you shoudl have asked for your wasted costs for attending; they clearlys erved no discontinuance notice on you.0 -
Just found out it was vacated by the court as the the Claimant did not pay the court fees.
They advised I ask the court to refer my cost schedule onto a judge for a decision.0 -
Yes, drop it back in without delay with a covering note saying you attended court, and thus you need the court to exercise its case management powers without application or fee, an grant your wasted costs.
Unfortunately some Judges will respond by saying you must file an application and pay £255! You won't know till you ask, and QUICKLY.
