CCBC Form received for UKCPM/Gladstones

Hi guys,

I had a parking ‘notice’ from UKCPM back in Feb 2016, sent in the template letter requesting all the legal stuff, got a response saying they are not obliged to provide it and that was all I heard for some time.

Last couple of months I’ve received the letters from Gladstones and now a MCOL Form for the same case. (At this point I must add we moved in June of this year and I’m only aware of these letters as my previous address is my parents home).

Before I go down the long winded route of defending the claim, do I just plead ignorant given the letters have not been sent to my new address? I updated my address with all and sundry shortly after moving.

    I bet UKCPM didn't feature in your list of 'all and sundry'? ;)

    You must now write to UKCPM furnishing them with your new address for service. Everything from now is on a strict time-scale and it would be a shame to lose out if, say, your parents were on holiday when important mail arrived.

    What is the Date of Issue on your Claim Form?

    Date of issue is 13th Aug

    With a Claim Form Date of Issue of 13th August, you must now do the Acknowledgement of Service by 1st September.

    Failure to do that, or file a Defence by then, leaves the way clear for the Claimant to ask the court for a Default Judgment against you.

    Probably not wise to bury your head in the sand.

    Unwinding that sort of predicament is not easy - nor cheap.

    Keith, point taken, I’ll get onto it ASAP.

    The problem I have is that given the time past with no further correspondence I have thrown out all previous letters sent and received, thinking the matter was dead and buried. Will I still be able to put a decent enough defence together without these, given it’s your typical FPN on private ‘managed’ land?

    a defence is based on legal points, so look at the typical defences to construct yours , after you do the AOS online

    also send the PPC & Gladrags an SAR under the new GDPR as well as informing them of the correct address for service of papers, getting all the copies of paperwork and photos etc (their evidence and paper trail so far)

    they had 6 years to try a court case, its been that way since 1973 in england and wales for any small claims case , so 2 years is neither here nor there and is a typical timeframe since Beavis lost in 3 courts

    But you have knowledge of the "ticket" and the Notice to Keeper - and their reply.

    Would you care to share the reason for the ticket and the type of car park e.g. residential. Did you also take a pic of the signs there at the time?

    Is what was said on the ticket, the same as on the particulars? Was what they were claiming on the signs?

    Just sent in the AoS.

    The car park is a private one outside a kids soft play centre. We had privately hired the centre after hours for our daughters birthday party and were told by the staff we would be fine to park in one of the few bays just outside. After the party we came out to see a parking notice stuck to the windscreen.

    Unfortunately I now longer have the ticket or any other documents that were sent back and forth. I am assuming the SAR will cover this?

    The Particulars of Claim state for breaching the terms of parking on the land at...... Should the terms referenced be stated on the form?

    Has anyone got email addresses for UKCPM and Gladstones I can send the SAR to?

    This is the defence of estoppel (google it or search the forums). You had an honestly held belief which you will support with a Witness Statement from the soft play centre.
    I am assuming the SAR will cover this?

    The SAR will get the paperwork and the signs but you weren't looking at the signs due to the comments by the staff whose word you had no reason to disbelieve.
