Excel Parking Services - Flipped Ticket

Family member has received a notice vehicle at St Cuthberts Way Car Park, Darlington (DL1 1RP). Valid ticket was purchased, and looks like the wind/door draft has caused the ticket to flip over on the dashboard.

Contravention: 83) PARKED WITHOUT CLEARLY DISPLAYING A VALID TICKET/PERMIT.
Site Enforcer: Excel Parking Services Limited.

MyParkingCharge.co.uk - shows photos and requests £60.00.
Appeal option is available, but I assume this is useless.

    Start by reading the sticky thread for NEWBIES, then send the template appeal from The Keeper that you will find there.

    Thanks for your response, do you mean send the template appeal via the "Appeal PCN" function on Excel website?

    Yes, you of course send it using their method
    Watch out for drop down boxes preselected to something like "i am the driver" , or that yo uare required to select from nonsense options that dont apply. Just write something blindingly obvious in the case of the latter.

    Excel desperate for money again.

    Hope you kept the ticket to show a judge if it got that far.

    Appeal by all means but expect rubbish back.
    The second appeal is with the IAS which is a scam set up
    and no point wasting your time with them.

    Then along come very dodgy debt collectors who tell lies
    and are POWERLESS so you ignore .....then wait

    Dear Sir/Madam,

    Re: Alleged Parking Offence Reference XXXXXXXX

    I have received your letter dated XXXXXX wherein you make threats about Legal Action. Firstly, I am extremely disappointed to have received this correspondence from you as I have in fact tried without success to contact you on more than ten occasions when I originally received the original request for money from you.

    I fear that there is an element of malicious proceedings from your part, and therefore to ensure the most fair way to proceed I have aired on the side of caution and mailed this to each and everyone of your offices.

    I say that your original allegation is erroneous. For me to resolve this matter I require:-

    All of the evidence that you have regarding this alleged offence
    Proof of contract between myself and your client company
    Proof that I was the driver
    Proof of your genuine loss
    Proof from HM Land Registry that you are the land title holders

    If you cannot provide me with this information within 21 days from the date of this letter I will assume that this matter is settled and all parties to be in agreement.

    Fruitcake suggested, and you seemed to agree, that the best option would be to send the template appeal from the NEWBIES thread.

    Why have you now decided differently?

    Having said that, of course it is entirely your choice what you send.

    Were they to take this to court they would be likely to crash and burn. Many judges regard flipped tickets as a trifling matter, and the Law does not concern itself with trifles, indeed one judge has ventured the opinion that such flimsy tickets are unfit for purpose.

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

    Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    Hospital car parks and residential complex tickets have been especially mentioned.

    The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the House of Commons recently

    and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas.

    debt collector letter, not an LBC


    an LBC would give you 30 days to reply and in addition they would include financial forms too


    EXCEL have 6 years to issue an MCOL
  • Exactly same BS letter I got from these clowns a while back, expect another one (maybe two) then one from Zenith (same bunch of clowns different desk), all complete waste of paper but unfortunately some poor suckers take the bait and pay, don't be one of them!
