  • I've Just found CouponMads 2nd response to BW....

    Dear BW Legal,

My letter was not a 'query'. Stop patronising me and acting like you are a customer service agent. You and your ilk are a serious threat to consumers in this country. Cease and desist - this is now unwarranted harassment and your client is causing significant distress to me and my family.

It is important that you now stop contacting me pretending you are wanting to 'help' discuss an ''affordable payment arrangement'' for a debt that does not exist. How dare you demand that I complete details of my income and expenditure, for a fake charge from a notorious ex-clamper, propped up by you, a shameful robo-claim legal firm who were named and shamed in Parliament last month.

That one … I shall send some of this back to them

    What does this mean?

Have you received a Claim Form from the County Court Business Centre?

If so, what is the Date of Issue on that Claim Form?

In my letter today today, they wrote: Your vehicle entered the carpark at 15.48 and a ticket was purchased at 15.50 for 1 hours purchase. Your vehicle did not exit the carpark until 17:05 and as per the BPA Code of practice "you should allow the driver a reasonable period to leave the private carpark after the contract has ended, before you take action."We have allowed 10 minutes grace period after the expiry of the ticket and your vehicle over stayed your paid ticket by 12 minutes which is 2 minutes after we have allowed a grace period.
I bet the ticket machine clock is not synchronised with the ANPR timing clock. (Two minutes to drive in, find a parking spot, park, walk to machine, queue up, read the T & C's, pay and then collect ticket seems very quick).

No I haven't received a Claim Form yet so it was just an idea to start prepping for when I do. From what I have read it wont be long.

Hi guys, so I sent a response back after I received my LBA and its taken Bw Legal 2 months to collect evidence from NCP and send it to me (Which I've just received) even though I stated they had 30 days to send me it. They said my account was "on hold"... anyway do I respond to them arguing my point or shall I ignore the letter I received today and start typing up of my Acknowledgement of Service and gather together my defence letter for when I get my next letter.

Ah ok. It's the 'typing up' that confused me.

Not that you need it yet, but have you read the how to do the AoS guidance in post #2 of the NEWBIES thread?
    There is minimal typing involved.

I have trolled through it all day, is it under the small claims section? Don't suppose you could send me a link please? That would be a great help.

Yes... in the Small Claims section... post #2 of the NEWBIES FAQ sticky thread.

There is a link to a Dropbox file towards the beginning of that post.
  • I am in the right place then. I have read it all, I am just going through some of the cases which have been won.
