    Youre not using "the real reason" in court
    Your witness statement will set this out, and cna be used to correct your use of breastfeeding when you meant to state xxx
    Eiether way it is still a protected activity (Is it? You need to actually check this, or tell us so someone can go do that work for you!) and so the basis of the defence has not altered.

    Have I done a witness statement yet? Sorry, so baffled by this whole process. Really appreciate all this help.

    I wrote that the reason for being overdue was getting our baby in and out of the car, changing her nappy and having difficulty with the new pay and display machines.

    Will our defence allow for this as a private activity?

    You must not be baffled by it

    The entire process, start to finish, is set out in post 2 of the newbies thread
    You MUST read it, more than once, to understand not only wher eyou ARE in the process, but what your next steps are, so you can prepare

    If you have a court hearing date, then absolutely, without any discussion, you will have been told when documents you are relying on must be served to all parties. This includes your witness statement.

    You seem to be not understand what a defence is
    It is a legal argument why you are not liable
    Dealing with a newborn can CERTAINLY be protected under the EA2010, and you really need to have been looking into this; after all, its your defence, not ours, you need to know what your grounds are. You could also have been looking at other threads, uisng sensible searches such as "newborn", to understand your rights under the EA2010.

    Does changing a nappy in the car in the car park come under 'protected characteristics' of the Equality Act?

    No, just said to mention that there had been amendments and it would be fine. The person I spoke to also worked in the payments department so I would've thought she'd have brought up a fee.

    No, not in a million years unless the baby had relevant (bowel-related) protected characteristics. Not joking.

    Now, when is your hearing - do you have a date - and if so, when does that same court letter say both parties MUST serve & file Witness Statements and evidence?
