What was the date of BW Legal's letter of claim you referred to in your first post?0

Not sure exactly, but think it was June or July this year.Building my kids' savings from day one. Education and consistency are key to financial control.

Your defence was incorrect
Not your DQ. Thats just an admin form for deciding which court and how much time is needed
What yousay is as this was a year ago the issue was to do with teh baby, as they have helpfully confirmed. The precise reason is unimportant - it was still dealing with an infant of...
SUggest they discontinue on a "drop hands" basis.
Howveer you have neatly highlighted why we TELL people to send a SAR. Means you get ALL data held by the claimant.0 -
They are trying to scare you.So it appears we may have made a mistake. In our defence we wrote about breastfeeding being the issue.
However, BW Legal have written back to say that this was never stated in our initial appeal.
WHY believe them and worry that you 'made a mistake'? Be more robust about this absolute scam. You did NOT do anything wrong.
Ignore them or suggest they discontinue because CLEARLY as a busy new Mum threatened by this scam PCN, mentioning some details about the looking after/nursing of a baby in the appeal you had to fit into your busy life (where you hoped the parking firm actually had a heart and you didn't realise it was all a con), does not preclude you from expanding more fully on this at court stage and making it clear that the activity included breastfeeding.
Honestly how dare firms like BW Legal even exist? How dare they scare you like that, making you think you've done something wrong by defending! Be confident.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

So we asked for the court location to be changed, which has been approved. The new court hasn't received our defence from the original court. They've written to us asking to send them another copy.
This is fine, but do we take this opportunity to highlight the mistakes in the original we made and include a revised version too?Building my kids' savings from day one. Education and consistency are key to financial control.

Of course not
The claimant can then pick up on your amendments, which they havent seen, in the actual hearing. You will then find yourself in hot water.
Youve likely already been told this, but if you want to amend your defence, your only choice is to file an applicaiton to do so. You will not get this fee back.0 -
So breastfeeding wasn't the cause of our delay on this occasion but it was still dealing with my baby. Does that make a difference? Do I need to update my defence?Building my kids' savings from day one. Education and consistency are key to financial control.

Ok, I wasnt clear enough
In order to amend your defence, you have to file an application with the court costing £100 or £255 if you need a hearing, asking for permission to do so. You wil not get this fee back as this is your fault.
Make your decision based on that.0
