Spotted damage on car after PCP purchase - what are my rights?

Hi
My wife bought a used car last week on PCP from a Toyota main dealership. When she brought the car home I noticed severe scuffing on the alloys, dents and scuffs on the paintwork.
My wife sent an email with photos straight away to get this rectified. They have responded 3 days later.
What are my wife’s rights here? If we have entered into a PCP on a car with pre-existing damage, will we be liable for damaged on returning the car? Should the dealership get this fixed for us?

Was it manufacturer approved car? They should have list of checks they do and just fix it under approved car promise. Not sure how good is Toyota, but Mercedes fixed a lot of small issues and refurbished the wheels second time, after it wasn't done properly first time.
What was the response from dealer?0 -
Interestingly initially they tried to fob me off. Then I pressed them and I got this response:
"As a good will gesture I can speak to the manager at Northampton and ask if he can get the wheels touched up and the mark on the bumper polished out as best as we can.
Thanks”
I then (based on your advice) linked them to their own website which states all approved vehicles are fully refurbished. Which ours clearly wasn’t.
I will let you know the response.
Why do used car salesmen have to be such ******0 -
At the risk of asking the obvious.....
Why didn't you (or the wife) check the car over before hand? Much easier to sort problems out then as dealer will still be after your money!0 -
They could be worse despite you thinking they are w's. They could have denied all knowledge and responsibility and done nothing since you didn't do a thorough check either pre-purchase or on handover.0

They didn!!!8217;t move the car on our first viewing as another was blocking it so we didn!!!8217;t get a proper detailed view. The second time I wasn!!!8217;t there, my wife picked it up and she isn!!!8217;t the most perceptive.
Ultimately it shouldn!!!8217;t be considered the customers !!!8220;fault!!!8221; if something is missed when purchasing a car. It!!!8217;s a stressful time with a lot of spinning plates, and sometimes things can be missed. The dealerships T&C!!!8217;s are clear when it comes to approved cars. If they forgot to refurb the car, they should honour their customer promise and do it.
Its about integrity and values, some people have them, and some don!!!8217;t...0 -
So you also bought without even driving it?0

You saw it once, didn't even move it, and the next time you saw it was when you collected it?0 -

It's a two way contract and you have responsibilities too. If you return it rather than pay the balloon payment, then the condition of the vehicle will be checked for anything over and above fair wear and tear. You do check hire cars on collection don't you, taking photographs of already present scuffs and scratches and windscreen damage?
You should treat this just the same. The fact that you didn't means that you left this open to abuse, which the retailer hasn't done.
Taking a PCP on a used car is bad enough, generally unless you have got a super low APR. But not test driving it and not getting it out so you can inspect it? That way lies madness. I would have walked away had they refused a test drive of that car. How do you know you don't have a lemon?0 -

How do you know you don't have a lemon after a quick drove round the block?0 -
Yes yes yes - look I was asking a specific question, I don!!!8217;t need the passive aggressive !!!8220;I told you so!!!8221; attitude from the righteous internet community. I!!!8217;m simply asking for my rights as a consumer.
It!!!8217;s very easy to throw out the !!!8220;should have!!!8217;s!!!8221; but I!!!8217;m asking very simply for some guidance.
Please refrain from pointless strawmans.0
