    OP, if your wife bought a new fridge or washing machine, would she not check it upon delivery to see if it had any dents or scrapes? I know mine would.So why would she not do the same when collecting a new car?
    You keep banging on about your 'rights', which have been explained exhaustively, but little about your responsibilities: to carry out a basic inspection before signing the paperwork. It's just common sense. Had the dealer been iffy, they could simply have stated that the damage must have occurred after handover, and you wouldn't have a leg to stand on.

    They wouldn't even need to do that. CRA states:
    (1)Every contract to supply goods is to be treated as including a term that the quality of the goods is satisfactory.

    (4)The term mentioned in subsection (1) does not cover anything which makes the quality of the goods unsatisfactory
    (a)which is specifically drawn to the consumer’s attention before the contract is made,
    (b)where the consumer examines the goods before the contract is made, which that examination ought to reveal, or
    (c)in the case of a contract to supply goods by sample, which would have been apparent on a reasonable examination of the sample.

  • Okay, I have asked for support and I have received a couple of decent answers which I appreciate. Now I am getting the transition lens wearing dregs of the internet passing on their unhelpful passive aggressive comments. Maybe you made some decisions in life which means you!!!8217;re on a significantly lower income than others, do you think people pointing that out helps you out? Have some decency and integrity...

    As I have said before, the car is a Toyota Approved Used car and their terms state how the vehicle should be received. I was simply asking what my right are.
