Ebay Dilemma - what would you do?

Well I emailed him yesterday afternoon asking for a return label and he hasn't responded. Until he does, I can't do anything. Ball is in his court0

Now that you've done that you can leave it. He has the option for arranging a return and should he get funny about it later you have the email proving you were trying to co operate. I'd disagree with most of this.There is no case open so ebay is not involved at all and anyway ebay do not issue labels for NARU'd sellers where there is a chance they can't recoup the money. Ebay do not see any return requirement here, that is between the seller and the buyer- so it is immaterial what ebay know or don't know about sellers address, it is nothing to do with them anymore.
It is easy to contact ebay support without a case, there is a chat icon at the side of every page.
eBay do have have discretionary payments available in CS, to cover all types of cases.
Its everything to do with eBay, they have far more info on the seller than the buyer does.
