If your issues isn't the price then why did you say you are prepared to pay what he paid?

Its called drop shipping, many 'businesses' do it, rather than hold stock they send direct from their supplier

Because the purpose of paying 27.99 rather than 14.99 was to receive them earlier. Since they only arrived on the 19th I'm in no better position than if I had ordered them directly. Besides this, he would be saving money on return postage if I kept them

Just kick this one "upstairs" to eBay customer service via a dispute. Stick to the facts, and say you don't want to be out of pocket, but are not sure what you should do, and ask them to recommend the next step.

eBay usally side with the buyer, and from what you have said, with the seller having changed his advert, they definatly will in your case.

glentoran, this is not a complaint about drop shipping, the buyer brought a "pre-order" item which the seller claimed they could deliver prior to the time available from their supplier.

    Precisely, thank you

I'm not sure you have read the thread? OP has received a full refund without any dispute from seller, OP now has the goods which they have not paid for and were asking if they can deny receiving them to avoid returning them.

As advised above, seller should be given any chance to pay or arrange for the return of the unwanted goods.

I think there's a few people who haven't read the thread, most notably the contingent of drop shippers, who think it's the holy grail of selling and are always puzzled and confused why people get so upset about it. :P

No I didn't ask that, I asked what would happen if I were to deny I had received them. Because presumably the seller wouldn't have much of a leg to stand on. I said I was tempted because the bloke is a tool and a liar. I haven't at any point said I was going to keep them. Right from the start I have said morally I know they should be returned, and i asked for peoples thoughts on it

I know its not.. entirely, however when the OP is complaining about being "ripped off" and that the person doesn't come into contact with the item its def an element of the complaint.

As far as my experience goes if an item is edited after you purchase in your purchased items you see the how it was originally (may be totally wrong here) so perhaps the opening posted did miss the pre order part of the listing,

The only thing that's happened here is late delivery, that is not ripping people off, The OP has a refund and should therefore return the items

I 100% did not miss the "PRE ORDER ONLY" that was added to the title after I had made the purchase. Amazon was pre order for the 18th of June so I triple checked this before purchasing.

The seller knew from day 1 that they wouldn't be despatched until 18th June so to mark it as despatched on the 20th may is deceitful

I will return the item if I am provided with a return label

Not sure you understood me (or the OP)

By passing the decision on to eBay support, they have the option to issue a return label on behalf of the seller (or not). eBay know far more about this seller than the OP, so are better placed to take the "right" choice.

As a for instance, one senario is; the seller may have used a fake address, ebay know this due to previous failed returns, and hence ebay know there is no return route, but would not tell the buyer this.

We have so little info here, there are many reasons a seller can be banned by eBay, which only eBay truly know.

There is no case open so ebay is not involved at all and anyway ebay do not issue labels for NARU'd sellers where there is a chance they can't recoup the money. Ebay do not see any return requirement here, that is between the seller and the buyer- so it is immaterial what ebay know or don't know about sellers address, it is nothing to do with them anymore.
