    Hopefully, this might help??

We had an experience of purchasing a sauce pan (!) from Tesco's where the handle's design was such as to transmit considerable heat to the user.

We took the pan back and the store immediately refunded. It also alerted Tesco nationally to the existence of this fault.

As is our practice, we also notified Trading Standards. This was not because we're vengeful lunatics but because Trading Standards can actually work with a company to everyone's benefit -- not simply prosecute it, as so many seem to hope.

Trading Standards asked us if we were making a complaint. We said no. What we were doing was providing information about a home safety issue. On which basis, T/S was as grateful as Tesco had been.

A week later we received, out of the blue, a goodwill payment from Tesco Customer Services. We hadn't sought it. The gesture was appreciated.

A few weeks after that, however. . .

The saucepans were back on display.

Either a glitch had occurred in Tesco's handling of the situation, to the extent that it was now selling that which -- as the record of its actions proved -- it now most certainly knew to be unsafe. Or the item had been substantially re-designed in the interim.

    We notified Trading Standards again.

Notification was made on the basis that as the store had acknowledged the problem, refunded because of the problem, and even made a goodwill payment in respect of the problem, then it could not now be excused for allowing what looked like the exact same problem to arise again.

T/S agreed with that view and went off to investigate. We've no idea what happened. But the saucepans vanished, never to re-appear.

Conclusion: although it's possible for all of reasonable disposition to accept that good-faith mistakes can be made, once that has been drawn to the attention of, and recognised by, the person / company making that mistake, then there is no immunity from consequences, civil or legal, should that same mistake be perpetrated all over again.

It's evidence of complete inertia or complete indifference -- neither of which is in the consumer's interest and neither of which constitute an acceptable defence.

Though the likely consequences of repeatedly selling potentially dangerous hardware are obviously more serious than repeatedly selling a mis-priced item, the principle remains the same:

If you can't be bothered to make sure that a mistake once committed is not then repeated, the fault is entirely yours, as is liability for whatever consequences may follow.

Wig, you still have not managed to find a sentence anywhere saying a single incorrect sel is illegal. Phils case isn't applicable as mutible price labels with no robust system of correction then could be branded as miss-leading, but not a single price label! Phil, pos is advertising and comes under seperate acts.

Wrong. All the cases you mention are offences and all of them are covered in the same Act.

This is from the government's own website and is a definitive statement of the law:

    http://www.opsi.gov.uk/si/si2005/20052705.htm
    1. Section 20 of the Consumer Protection Act 1987 makes it a criminal offence for a person in the course of his business to give consumers a misleading price indication about goods, services, accommodation (including the sale of new homes) or facilities. It applies however you give the price indication—for example, in a TV or press advertisement, on a website, by email or text message, in a catalogue or leaflet, on notices, price tickets or shelf-edge marking in stores, or if you give it orally, for example on the telephone. The term "price indication" includes price comparisons as well as indications of a single price.

All I asked Wig was for you to find a link to Tescos being finned for an incorrect sel or sel's. Phil, a well know Tescos hater should have been able to find one but could only come up with that Somerfield case.

Not everything in the world is on Google, you know. I don't have access to all the filing cabinets of every Trading Standards department in the country.

The fact that Somerfield were prosecuted for it is good enough and proves my point.

Well Ill be expecting the call myself too then as I have to ring them every week, because ive either got something missing, damaged or out of date that day or the day after!

Every week I also have several items sold out and several then substituted but the subsitutes are either double in price or totally unsuitable. Which then means Ive only half of my shopping so still end up going shopping. Why do we bother with tesco.com?

Think its awful though banning people, they really need to concentrate on sorting themselves out. Their out for our money and dont care about how they treat their loyal customers!

The manager at the store where my order comes from is closely monitoring my account and customer services can no longer issue me refunds as apparently its happening too much for their liking. They made out as though its my fault!

You cant blame them for monitoring people who constantly ring up for refunds for missing items etc - i would imagine any company would if a customer was constantly saying items were not delivered.

Not sure why its awful to ban somebody from their home deliveries, makes business sense if its causing more problems than any profit they are making.

At the end of the day, you choose to shop online with Tescos - if your not happy then why continue to use them?

I've only once ever had anything missing from Tescos but the driver came back with the bag before I even noticed!

  • I constantly have to ring up as my rejected items do not get refunded - not huge sums but still my money - - I expect to have some substitutions - if I physically went shopping myself I would on occasions have to buy alternatives but I too do not wish to buy alternatives double the price.

This week I had to phone as all the multisaves that started that day did not get deducted - approx £8 worth.

I am overall happy with service but find the failure to refund my money irritating.

Kind of agree with Daisyflower - if this continues they will eventually ban you - like they have others.... Don't think they are going to worry about a few lost accounts - not with their profits

From what I gather though it wont be just a few, others have had problem after problem with them and if they go on to ban these customers theyll soon loose almost everyone as their level of service just keeps on declining and they just dont care so soon it will affect mroe and more people
