Just this second spoke to the FOS, and he told me that this can be done but it is vary rare, as for Black Horse it is very unlikely because they are part of Lloyds who are likely to be the underwriters and they will just say that they weren't regulated at the time. He suggests the best option is getting a solicitor myself as the FLA won't do anything either!
What a nightmare!
I think I may look into solicitors that will take on this as a no win no fee - but I think I may have trouble there too.
I'm going to have to think about this one.
Thx
Michelle
Hi Michelle
The underwriters to what I know of are same as the insurers, hopefully someone in this same position will post up for you, who are currently dealing with the insurer of BH, I am sure some have continued to go this direction.
Keeping my fingers crossed for you.;)

Update again! I have contacted a solicitor (not one of those reclaiming companies), he is willing to take the case on a no win no fee basis, and as the claim is for over £5000 then I will get the full cost of anything back.
I feel at this point I have nothing to lose by trying this, apart from a small reduction in my monthly payments! Anyway he is sending me some paperwork, so I'll have a good look through and make my final decision based on that. I'll keep you informed as to how this goes.

when you paid off the car - were you forced to pay all the PPI as well as the loan capital?
I paid a monthly amount of £189.00 for a 4 year period, paying over £2000 in insurances that i was told i had to have.'Dont Bury Your Head In The Sand As Your Problems Will Still Exist'

I'd appreciate being giving contact details for your barrister. I've wasted two years having the Financial Ombudsman drag out their investigation, only to have them find in favour of GE Money. Now the Finance and Leasing Association have basically said that it is difficult for them to prove mis-selling of ppi, in retrospect. Aren't all cases in retrospect?!
I'm so fed up, where can I go now?PaulinWeston wrote: »Hi Everyone! I'd just like to say that I've been in contact with a barrister who is specialising in all types of PP claim.... Boy-oh-Boy WHAT a revelation....... There's so MUCH to say but get this:0 -

Hi there
Sorry to hear this, but you could try the insurer direction, the FOS are suggesting this direction to many who have been in the same situation.;)The one and only "Dizzy Di"0 -
di3004 - Is the following letter suitable to send to an underwriter?
I purchased a vehicle on finance from Lenders Name based in Location, in the early part of Date and as part of the finance agreement I was to take out various insurances, as an underwriter, your company provided these insurances.
It has recently been brought to my attention with the media / press coverage with regards to mis-sold Personal Protection Insurance ( PPI ) I now believe that this was the case with these insurance policies. I have written to Lenders Name detailing my concerns and requesting the repayment of all monies paid & any subsequent interest but, they have refused point blank that these insurances were mis-sold & as such I believe that as the underwriter you also have certain responsibilities to ensure that they are sold in the correct manner & are fit for purpose.
I believe that the policy was not fair and reasonable & as such I am requesting a full refund of all the premiums, subsequent interest on those payments & as I believe I have been deprived of this money I also expect 8% statutory interest, the amount a court would award, to be added to each payment made.
I look forward to a full and prompt response to this letter and for the matter to be concluded within eight weeks or I shall be contacting the Financial Ombudsman to further investigate my complaint.

Hi hun
Yes that is a great letter well done :T.
Make sure you get your proof for posting as well, to keep a check on those 8 weeks.
Good luck.;)The one and only "Dizzy Di"0 -
Can i just ask how do you find out who is the underwriter of a company x
Hi Woodymeg
I would write to the lender and ask that they send you the insurance policy document through the post, they are not always enclosed with your documents from when you have taken out the finance and to request for these separately.
The details of the insurer will be enclosed on the policy.;)XThe one and only "Dizzy Di"0
