    I understand when it comes to loans and mortgages its still payable when making a claim, however this may also vary depending from one bank to the other....
    Hopefully someone will post up to confirm in relation to the credit card ppi, good luck.

  • Hi all Im wondering if you can help me i did my 1st letter to welcome finace which i have just received a reply today they are basically saying stuff it, i took out the loan in 2001 so i know they are not fsa compliant so dont think i can go to the fos so what do i do now send letter 2 or where else can i go to. It is for a good sum if i can get as the loan was for 10,000 i cleared this off in 2004.
    Any help?

    Hi Hayley, you can make the complaint against the underwriter/insurer of the policy for misselling as FOS are accepting complaints like yours when not regulated at the time. You would have to find out who the underwriter/insurer was at the time of taking it out. Do you have any paperwork with this on? It would be on the policy documents if you have them.
  • Hi and thank you on your response to me just had a lok at welcomes letter and it says the insurer is Direct group ltd is this any help and what next step do i follow.

    Hi there and welcome.;)

    Was this actually sold by M&S Money?
    If so then yes go for it, if they were not governed or covered then when you taken this out by GISC/FSA, you can try the insurer/underwriter directions as another avenue.
    See what happens with the above first, as the FOS will only adjudicate complaints if governed by the above regulators.
    The insurer/underwriter would or should have been protected.;)

  • Hi all, Just wondering if anyone has any suggestions with the following,

    My husband took out a hire purchase agreement for a new motorcycle in 2003 the loan was with Blackhorse, he was mis-sold PPi with the bike (told he could not get the finance without taking out PPI) we have written to Black horse who say that it is the Bike shop who are in the wrong for the mis-selling. However they were not regulated with FSA until 2005. Is it worth pursuing the Bike shop for the PPI???

    Yes I would give it a go, but it may have to be through the insurer/underwriter instead of BH, some of us have gone this direction, also as suggested by the Financial ombudsman service (FOS), as they are trying to make these responsible as well, one of mine is with the FOS right now and many more on here.
    These would have been regulated.
    So go this direction, if they say no then off to the FOS.

    If you do not have these details, request for the policy from BH they should provide them on request, however I would ask for them in writing.;)

  • Just a quick update on my wifes card, the insurer for M&S cards in the early 90's was allianz. They are now looking in to it , they have been at it over a month now. Should I chase them up????

    They have 8 weeks in full to respond.
    If you hear nothing close on to that timescale then yes chase them up.
