Quick question does anyone know what basis companies have used to repay claims when the company has lost some of the records for the period of payment?0

Hi all,
Has anyone had any success in reclaiming PPI premiums where FOS has no jurisdiction?
Thanks!0 -

Hi All.I'm really sorry if I'm posting this in the wrong place (not sure how to ask a new question)
Anyway can anyone help in a nutshell I was mis sold ppi on a loan of 35,000 that was on a single premium of £6650 in Feb 2003. Due to getting into arrears we have realised that we have been misold it and that it only lasted 5 yeras of a loans!
We sent the ist letter which they repiled that it was timed barred and that they were not members of the fos in 2003 so out of their juristication. So sent second letter to them stating the Limitations Act 32c which they replied that it was still time barred and outside FOS juristication.
My question is really where do we go from here?
Any ideas
I've checked with the FLA and Central Capital have been members since 2008 can I still go that way for a claim?
Am I just left with the option of taking them to court? If so where do I start?
Thank you0 -

Hi there, I assume what they may also mean here is that they were not members of GISC (General insurance standards council) before the FSA taken over in Jan 2005.
I would in your case try to pursue this through the actual insurer/underwriter, the FOS are suggesting this to many who have been in the same situation, as the FOS cannot investigate complaints if these were not covered by the above regulators, where is highly possible the actual insurer would have been covered, so in this case the FOS are able to investigate this for you.
You basically write to the insurer as you have done the broker and if they write back and say no, then move on to the FOS.
If you want to check with the FOS first, then I suggest that it would be best to give them a ring, so they can confirm this to you as well.

If you do not have the policy details with the name of the insurer, then write to the lender or the broker for the details, the lender should provide these to you by post, and you should find details of the insurer with the address details on the policy.
Hope this is some help to you, please keep us posted if you can, good luck.:)The one and only "Dizzy Di"0 -
I have written a letter to the Insurance underwriter in regards to miss-sold PPI with YCC / DAF ( Who were not regulated at the time ) in early part of April, they have received & signed for the letter, does anyone know if there is a time limit to which they have to reply or at least acknowledge the letter?'Dont Bury Your Head In The Sand As Your Problems Will Still Exist'

Hi there
Hopefully they will acknowledge by 14 days, and they have the usual 8 weeks for the full decision.:);)The one and only "Dizzy Di"0 -
Received a reply today from NIG, it states that as the underwriters of the PPI they are not responsible or involved with the sale & the finance of the PPI & therefore unable to respond to the allegations or questions in your letter....the sale of the policy along with any finance agreement remains the sole responsibility of DAF & as you have already made contact with DAF concerning the sale of the policy, & they have responded, there is very little we are able to add.
So, not quite a full & final, what now?'Dont Bury Your Head In The Sand As Your Problems Will Still Exist'
