  • Just had a reply from Allianz they are going to refund the premiums. The only problem is M&S have given them the figures from 2003 where as the card has run from 1992 and they only want to put 8% on, I've asked them to look agains as I think it should be at the credit card rate at the time, or am I wrong????

    Hi there thanks for your update and well done.:beer:

    It could be that they do no longer hold all the details going back that far, normally they hold them for up to 6 yrs but if you have any of the info from earlier years, you could write to them and provide "copies" and ask them to work out the figures from them, and see if this will be of any help.;)

    ??? 8% statutory interest is standard and is should be calculated against each premium paid

    Hi ALL ,
    could i have some advice please !!
    I am just in the process of claiming some credit card charges back and become aware I was paying PPI in 2004 for PPI with Lloyds tsb for a credit card !! However due to low funds in 2006 I stopped the cover ! I am able to claim back the PPI from2004-2006 due to the fact I never claimed and I only taken it out so I would be accepted for the credit card ??? Please advice needed. x

    If mis sold for any reason then yes you can.

    More here on reclaiming with guidelines, template letters, try to use your own words though with help from the template letters, check the mis selling reasons as well, and write what applies to you, they have 8 weeks in full to respond, good luck with this, ask for help when required and please keep us posted.

    Hello there

    They are entitled to 8 weeks in full, sometimes they do get back and say they require further information.
    They do however have backlogs, so its discreetly up to you if you want to give them longer than 8 weeks if they say they need extra time, of take your complaint to the FOS, but please bear in mind, it can also take some time within the FOS (Financial ombudsman service), as they have a huge amount of complaints to get through and also backlogs too.

  • It looks like I may have to take the underwriters route with my PPI claim against Black Horse, as the loan was taken in Dec '04. Just out of interest has anyone had any success or experience with this route?

    Yes I believe there have been success.

    Mine is now waiting to be passed on to the adjudicator anytime now, and not have been refused, not BH though but a business that went down under in 2006, I was passed from pillar to post with the lender and HFC and so on, but the insurers are Hamilton and the FOS are suggesting for people to go down this route and trying to make these responsible.

    Its another direction to take if all else fails.;)

    Cannot remember who the actual insurers are on BH, although LLoyds rings the bell, but check first if you do not know at this poiint, if you do not have the policy BH should provide them to you on request, the details of the insurer would be enclosed on the full policy details.

    Just this second spoke to the FOS, and he told me that this can be done but it is vary rare, as for Black Horse it is very unlikely because they are part of Lloyds who are likely to be the underwriters and they will just say that they weren't regulated at the time. He suggests the best option is getting a solicitor myself as the FLA won't do anything either!

    What a nightmare!

    I think I may look into solicitors that will take on this as a no win no fee - but I think I may have trouble there too.

    I'm going to have to think about this one.
