Hi guys, hope you are all well... thought I'd take the chance to update this thread...
Not much has happened since I submitted my defence, MCOL website says Defence has been received and I also received a letter before Xmas from the court saying they had received my defence and would be passing it onto the claimant.
The letter states that they have 28 days from receiving my defence to contact the court, after 28 days the case is stayed, they must apply to the judge for an order to lift the stay.
Defence submitted on 17th Dec, not heard anything so far...0 -

Well, that's 35 days - phone the court right now. Get them to confirm its status. If they appear to be prevaricating and there has been no stay applied, ask that they consult immediately with a Judge to execute it.
You don't want the PPC slipping in through a half open back door. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

So, I have just tried calling the court, looks like everyone wants to get in touch with them as I was 91 in the queue, I have gotten their email address, wonder if its worth trying to get some info that way?0

You have one choice: get in contact with teh court or not
ASking us which method to use doesnt help
Just keep on the line OR email OR both, just make sure you get YOUR request for the clami to eb stayed in FIRST.0 -
So the court's letter said they would be sending your Defence to the Claimant. You have no idea when the court sent your letter to the Claimant. Did they have a backlog? Delayed due to Christmas?
So you have no idea when the '28 days' starts.
Even when the court gets the response from the Claimant, due to volume of work it is possible that the next stage, sending out the Directions Questionnaire, will be subject to delay.
In short, it may well be much more than 28 days before the court send you your DQ.
If you want to get ahead, then download your own DQ from the internet - as described in my 15th November post above.0
