    Just a little update for you.
    DQ received from the court and completed one from SCS Law.

    Posted mine next day which should arrive Monday before noon (deadline day) and emailed copies to both the court and SCS Law.

    Let's sit tight and wait and see what happens next...

    Morning everyone, sorry it's been a while but I thought I'd bump this and update you guys so far and see what your thoughts are...

    So I received my DQ and filed accordingly.

    I then received a letter from the local court which I asked to go to giving me a date for hearing and witness statement info etc.


    The hearing is set for 10am 24th May... great apart from the fact that in my DQ, in the part where I had to say what days your not available I entered 13-24 May, I fly back from Mexico on 24th and land at 8am... hearing is a 10 in Coventry...

    Seems bit strange to me that they have chosen a date which falls into the timeframe I said I couldn't do.
    I've read the letter from the court and it says if I cant or dont want to attend in the specified date I need to write to the court. They can still hear my case without me being there!

    I've tried numerous times to call them with no avail, I thinking of writing a letter and requesting to see if the date can be altered due to it being the day I said I couldn't do and explain the circumstances.

    Any thoughts or advice?

    Do you still have the copy of the DQ that you filed (if you sent it by e-mail then I guess you do), in which case, send it to the court (your local one) and ask for the date to be moved in accordance with your instructions in the DQ, copy attached.

    Hi guys!
    Well I emailed the courts as it was impossible to get through in the phone lines and also emailed a secondary email address for queries. This was Tues last week and I have still heard nothing. I am sending a letter next day delivery tomorrow stating the same as the email, that I would like the date rebooked, as it falls within the time I said I was unavailable (complete with DQ).

    I go on holiday 13th May, I'm thinking I should get prepared and submit my witness statements incase they dont get back to me and dont change the date of the hearing, then they will have to do it in my absence...

    So flipping annoying

    As it's the local court can you possibly go in person as a follow up to that letter and ask what the Court Manager is doing about this error?

    Have they put your letter in front of a Judge to vacate that original hearing session, so you know before you go to Mexico?

    Allow a couple of hours for this visit to sort this out. Don't go at lunchtime.

    Tell them you will wait while they sort it...do not be fobbed off, you need to know this week what they've done to get a Judge to rearrange the hearing date which has been put at a date and time your DQ excluded.

    Tell them this is NOT you asking for a new date for a frivolous reason, it's you telling THEM they have made a mistake as the DQ excluded 24th.

    Personally I would have said I wasn't available until the end of May, in your shoes.

    I haven't heard anything back as of yet, my letter was posted next day recorded last week as well as 2 emails previously. The court letter indicated they would need 7 days notice if you were not going to attend, I would have though I'm well within the time frame.
    I've began working at my new hob this week so I dont have the ability to go to the court and sort this in person.
    I'm really not sure what to do right now, do I file my witness statements I case they dont do anything about the date?
    I have until Friday this week to do that so if I'm going to submit then I need to get my material together asap.

    But you don't want to absent yourself from attending - YOU DO NOT WANT THIS CASE HEARD IN YOUR ABSENCE!

    Bumping to give you guys an update, I know it's been a while.
    My court date was rebooked and is taking place tomorrow. Not gonna lie I'm super nervous.
    Just in the process of getting together copies of my own docs as well as theirs..

    Will keep you posted as to how I get on.
