Can someone clarify something for me please?

Hi
I have read through various pinned and sticky posts and although it's a bit of information overload I think I have understood a fair bit.

One thing I wanted to clear up before I decide how best to proceed it the following:
Today a 'Letter before claim pursuant to the pre action protocol for debt claims' arrived.

Is this the same as a LBC?

several tickets of which were ignored as a parking permit was inside the car but not visible from where chappy took his photos from clearly, but there is no proof.

Any help appreciated

    Yes. That's what lbc stands for.

    So follow the newbies thread where it tells you how to follow up lbc. What would help us, as we can't read your mind, is to have actual details. BUT first EDIT YOUR POST and remove anything that says who the driver is.

    its a complicated topic, with no easy answers, hence the "information overload"


    when you learned to drive you werent expected to do it all in a few hours !!

    Thank you for your responses.
    The car park in question requires cars to display a permit. Of which was done everyday.
    Windscreen notices were ignored, SCS now wanting £800 for 5 PCNs from 2016.

    The letter they have sent sounds fairly robust and refers to the Pre Action Protocol and Practice Direction on Pre-Action Conduct.
    Not sure if any of the letter templates will be useful in this particular case?

    Oh !!!!!!!! is it robust! You know this from what, ten minutes on here?

    Have you read the PAP thoroughly, and know exactly what documents they must include? Just mentioning the applicable pap doesn't mean they've complied with it

    If you're not sure the templates apply, you don't understand the letter, the pap, the templates or all three. So which is it?

    They will.

    Adjust one of the sample LBC robust replies linked from post #2 of the NEWBIES FAQ sticky thread to fit your situation.

    Does your LBC give you 30 days to respond?

    Has all the information that they should supply with an LBC been supplied?

    The letter they have issued gives 30 days to respond.
    They have also listed dates, ref numbers, car reg, contravention type and amounts for all incidents.

    Contravention mentioned is 'Parking in a designated Permit Holder Parking Space wit clearly displaying valid permit.
    If the keeper argues that the permit was in place but the photographic evidence from that angle shows the parking permit not visible, does that seem like enough of a challenge? The PNs were also not challenged upon recieving them.

    Just trying make sense of what is the basis for appeal and is there a leg to stand on effectively?


    understandably this is the millionth time these questions must have been asked, the concern is that the keeper hasn't appealed the PCNs at all and trying to understand if anything can be done at all, I have read previously that UKPC can't force a payment - so whats different now?
    Thank you for any help/advice given?

    1. Check that all the documents to which you are entitled - as per PaP -have been delivered, if not demand them. When satisfied respond formally to the LBC using a forum template as a starting point to fine tune your own.

    2. If a claim is issued, defend it fully, with help from the forum.
    I have read previously that UKPC can't force a payment - so whats different now?
    No parking company can 'force a payment', but a Judge can order one. That's where you're approaching right now. So you must deal with it to get a Judge to declare no payment due.

    Do you have a tendency towards under exaggeration? :)
