The fact that the land is jointly owned still makes it private land. Private land could mean anyone owns it, as long as it's not a public highway. It could be a company or a partnership or whatever.
You'll need a solicitor if you want to do something about his parking. If all the other people who own this land agree, then surely there is a legal route to get the vehicles removed and/or place parking restrictions on the common areas.

The person who is at fault. Even if you are on the public highway and you run into a car that is untaxed, uninsured and without a MOT and the driver has no valid license you are still at fault and your insurance company would pay out no differently than if it were a fully legal vehicle and driver.

It isn't your property, you do not own it. The fact someone does something you all don't like is irrelevant if its legal. There is a high probability every single one of you does at least one thing that gets right up the backs of the others.
I have a suggestion. Purchase an island, go live on it on your own because that is only where you will be truly happy because when you live with neighbours you have to accept they're going to do something that you don't like and you all on your little cul-de-sac aren't prepared to accept that. With respect to the accident insurance, we are concerned with the public liability aspects..as these vehicles are rust buckets piled high with building materials which do not seem very secure......hence why we mentioned the public access and who could be liable....I should have been clearer.
Is it legal?...this is why I started the thread to try to find this out.....I.e. I understand that DVLA would not be involved as it is on private land, but this private land has public access, so was looking for any info as to whether this makes a difference.
This is all part of ongoing abusive behaviour to all the residents in our !!!8216;little community!!!8217; from this individual........Without knowing all the facts, suggestions for us to go live on an island etc., are not helpful or appreciated....we are new to this forum, so sorry if we do not appreciate the humour, if that is what it was.0 -
For SORN it doesn't matter whether it is the owners private land or a complete strangers, as long as it is not on the Queens Highway or a public place as defined in the Road Traffic Act then that will suffice.
Not quite. For SORN purposes, it needs to be kept off "a public road", which is defined as one repairable at the public expense.
This is quite different to the definition in the Road Traffic Act. And neither mention the Queen's Highway.0 -

The 3 of us own the land. If these vehicles have no insurance and something falls off the back of one of them and injures a member of the public.....who is liable?....the owner of the uninsured vehicle or the owners of the land where the accident happened?0

Unlikely a vehicle would need to be taxed to be on private land. I suspect the only legal route concerns what rights residents have with regards to access and use of the privately owned road.

Is the council liable if a 'bit falls off your car' on a public street?
How many instances have you heard of a part falling off a car and injuring someone? More so on a dead end road with few people walking along it?0
