Sorned car on jointly owned private land
We are residents of a small development of 4 houses in Scotland, 3 residents jointly own the common access road, with one further resident only having access rights. One owner has a company and has dumped 2 of his company vans in this access road for months now and has Sorned one of them (although not obstructing the access, this does limit visibility at a turning into a communal courtyard). The majority of owners want the vehicles removed....is there anything we can do to get these vehicles moved?......can a Sorned vehicle be on jointly owned private land if the majority of owners are against this?

I own the freehold of my land, but there are restrictions/covenants within the paperwork that prevent me parking any vehicle/similar that "can be slept in" (e.g. caravan or a campervan) - and no vehicles that are off the road.
Check what's in the paperwork as one starting point.
As they are work vans, they are not for "activities of a residential home", but are "commercial vehicles, associated with commercial activity" - which might also be mentioned in your paperwork (e.g. here I am not allowed to run a business from home, even though the house is freehold).
The starting point of knowing what you can do - and then how - is to go through the paperwork/deeds/restrictions/covenants and see if you can spot something to pin your efforts onto.0 -
The land registration documents do say that....each house and relative offices shall not be used to carry on therein a trade, business, profession or from the selling of any goods or wares of any sort that causes a nuisance to other owners or occupiers..however his company is not registered to his home address...Is this a !!!8216;relative office!!!8217;?....The missives say that the access road is only to allow vehicular and pedestrian access to the house they own...it states nothing about parking.0

That sounds more to do with running a business from home, nothing to do with vehicles.
Is there anything else?0 -
My main question is whether one of the joint owners of private land can dump a Sorned car on it, when the majority of owners do not want this. Also there is another car which was dumped on the road 8months ago, not Sorned......just looking for a way forward to get rid of these vehicles.0

Would you have the same concerns if it was a 6 month old Ferrari?0 -
..and your point is?0

Yes, as it reduces visitor parking to the other houses......0

Has anyone actually asked him when he is going to remove the vehicles ?Never pay on an estimated bill. Always read and understand your bill0

The SORN status is not relevant as to whether it's their with permission or not. Two separate things.Changing the world, one sarcastic comment at a time.0
