Tesco do this all the time, always have. It's a 'two strikes and you're out' approach where they ignore an overstay the first time but retain the data, might be worth an ICO complaint afterwards but Tesco will justify it.
What would be bad, is if they retained data about a car for a number of months then you sell it in the meantime, and they then assume the second overstay is the same person. That might get the ICO interested.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

HV's NtKs are never PoFA compliant. It's the 'bigger fish' we are trying to catch at this stage. HV will cancel when a forum appeal is received, and the OP has until the end of this month to do that.
It was the additional information about the Tesco letter that put a temporary halt to advising the OP to appeal immediately. If you read my first post on this I said this would be over by close of business Monday, but then it all got a bit more interesting.
Two issues.
Parking charge and Data protection.
They need not be mutually exclusive. Get the ticket cancelled first and they involve Tesco re the DP issue and letter.0 -

Given that there's over 3 weeks available for the initial appeal, with a guaranteed positive outcome, there was time to play with.

Hi,
I was trying to get information regarding a notice I received and came across your post, which is ALMOST exactly the same as mine! Even the alleged duration of "stay" is the same - 3 hrs 41 mins! 1st "alleged" offence was also in February (04/02 - which i could neither acknowledge or deny as honestly cant remember!) which, in the letter from "Tesco", was also "overlooked" as I was "a valued customer".
The date of notice is 28//03/18 and the date of offence was 05//03/18. I did not receive the notice until 04/04/18, and cannot say when exactly it came through the letter box as I was away from home from 01/04/18 (and it was not in the post on this date) until my return on 04/04/18 (bank holiday weekend).
According to the information on the site, as the registered "keep", I should have received notice within 14 days of the alleged offence, which quite clearly, I didn't get.
On top of this, I was not the driver on this occasion - family were visiting from Australia and had use of my car (they returned home on 06/03/18 so are no longer in the country). I have since spoken to them and they stated that they did a drop off of their daughter at Tescos (was going to the cinema) and then returned to pick her up, so were not parked for over 3 hours!!
I had copied the letter of appeal but then noticed that this was for England and things were different in Scotland but after trawling through the posts, i cant find anything relating to Scotland. I've tried searching under Highview, Tesco parking and Highview parking Tesco Scotland but nothing specific to Scotland. I don't want to use the letter if it does not apply in Scotland?
Any advice or step in the right direction would be most appreciated.

It's not thought because in Scotland you have no POPLA. DO NOT APPEAL.
