Ignore the £40 discount bribe, you'll be paying nothing if you follow advice and don't make this too difficult for those giving freely of their time to help you with your problem.
We have up to 100 separate cases every day to deal with, and you can count the number of regular advisers on not much more the fingers of one hand.Please note, we are not a legal advice forum.             I don't understand why we have reached post #28 and nobody has picked up the absolute Golden ticket, sure fire winner that HV will cancel IMMEDIATELY. I know, as I have won on 2 occasions.
Date of contravention 21/3/18
Date of NtK issued 4/4/18
Look at a calendar. The LAST date that HV have to get the NtK into your hands is 15 days after the 21st. That would be the 4th April. But POFA says that they have to allow 2 days for postal delivery meaning that it would not be deemed delivered until 6th April, thereby not permitting them to pass the liability on to the Registered Keeper, only the driver.
You appeal as follows.
"With reference to your speculative invoice xxxxxx dated xxxx, I admit to being the registered keeper on dd/mm/yy. However, I will not be informing you who the driver was at the time.
In order for the Registered Keeper to incur liability, the strict conditions of the Protection of Freedoms Act 2012 must be adhered to.
I am sure you are familiar with Section 4 and, in particular, the following re Keeper Liability
(4)The notice must be given by!!!8212;
(a)handing it to the keeper, or leaving it at a current address for service for the keeper, within the relevant period; or
(b)sending it by post to a current address for service for the keeper so that it is delivered to that address within the relevant period.
(5)The relevant period for the purposes of sub-paragraph (4) is the period of 14 days beginning with the day after that on which the specified period of parking ended.
(6)A notice sent by post is to be presumed, unless the contrary is proved, to have been delivered (and so !!!8220;given!!!8221; for the purposes of sub-paragraph (4)) on the second working day after the day on which it is posted; and for this purpose !!!8220;working day!!!8221; means any day other than a Saturday, Sunday or a public holiday in England and Wales.
By consulting a calendar, you will see that you have failed to meet that strict deadline and I therefore invite you to cancel the charge or provide me with a POPLA code so I can make an appeal (which will cost you money) to them.0 -

ah, this one is about a possible data breach against the OP
and maybe hundreds of other people0 - 
            HV's NtKs are never PoFA compliant. It's the 'bigger fish' we are trying to catch at this stage. HV will cancel when a forum appeal is received, and the OP has until the end of this month to do that.
It was the additional information about the Tesco letter that put a temporary halt to advising the OP to appeal immediately. If you read my first post on this I said this would be over by close of business Monday, but then it all got a bit more interesting.Please note, we are not a legal advice forum.
