    I think I've found the Edna Basher letter which reference para. 13/14?


    Is this not for when a postal notice has been issued? I only currently have the PCN that was stuck to the cars window?

    If you only have the windscreen notice, then just send the usual MSE forum template at about day 26. They shouldnt then contact the RK

    Hello

    I've now received a Claim Form from Northampton County Court.
    I didn't receive a LBC before this arrived.

    Issue date: 27th March 2019.

    Been away on holiday and letter arrived day I was going.
    Did the AOS online on the MCOL site on the day I went away.
    I assume doing a SAR is now not worth doing as I'm quite close to the deadline?

    The Claimant is Norwich Traffic Control and they are using BW Legal.

    "The Claimant's Claim is for the sum of £100.00 being monies due from the Defendant to the Claimant in respect of a Parking Charge Notice (PCN) issued on -DATE- (Issue Date) at -TIME- at -PLACE-.
    The PCN relates to -MAKE- under registration -REG-.
    The terms of the PCN allowed the Defendant 28 days from the Issue Date to pay the PCN, but the Defendant failed to do so.
    Despite demand having been made, the Defendant has failed to settle their outstanding liability.
    The Claim also includes the Statutory Interest pursuant to section 69 of the County Courts Act of 8% per annum a daily rate of 0.02 from -DATE- to 26/03/2019 being an amount of £7.36.
    The Claimant also claims £60.00 contractual cost pursuant to the PCN Terms and Conditions."

    Amount Claimed: £167.36
    Court fee: £25.00
    Legal representative's costs: £50
    Total amount: £242.36

    I've posted the above following the advice on the Newbie Sticky Post No.2.

    I intend to do some research/reading up over the next few days and draft a letter which I will post here before submitting.

    Any input would be appreciated?

    With a Claim Issue Date of 27th March, and having done the Acknowledgement of Service in a timely manner, you have until 4pm on Monday 29th April 2019 to file your Defence.

    That's a week away. Loads of time to produce a Defence, but please don't leave it to the very last minute.


    When you are happy with the content, your Defence should be filed via email as suggested here:
      Print your Defence.
    1. Sign it and date it.
    2. Scan the signed document back in and save it as a pdf.
    3. Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
    4. Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
    5. Log into MCOL after a few days to see if the Claim is marked "defence received". If not chase the CCBC until it is.
    6. Do not be surprised to receive an early copy of the Claimant's Directions Questionnaire, they are just trying to keep you under pressure.
    7. Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of the NEWBIES FAQ sticky thread to find out exactly what to do with it.

    Send a SAR anyway. The information returned is likely to be of more use at Witness Statement time which is some weeks/months away.

    Am I to send a SAR to NTC and BW Legal?
    I guess it doesn't hurt to do so?

    This is the SAR I have pinched from elsewhere on the MSE forum and adapted for NTC:


    Dear Sir


    Account Reference: XXXXXX


    I am writing to you in your capacity as Data Protection Officer for Norwich Traffic Control (NTC) so that you may provide me with copies of ALL documents (paperwork, pictures, evidence) that you hold in relation to this case.
    Due to the woefully inadequate particulars of the claim presented, it is imperative that NTC present copies of all data they hold on the Account Number XXXXXX.
    I am sure NTC will already have this data to hand in order to issue the claim in the first instanca. Therefore I demand that NTC provide all documents within 7 days.

    I require screenshots/copies of all photos (whether sent in a letter or not) and all internal notes, emails, status updates, DVLA look ups and all online data held/stored or shared by you, about me or my VRN, which is personal data in itself.
    The NTC site suggests that verification of identity is required for this request to be carried out, and for this reason I am sending this email from the email address that NTC has previously corresponded with on the matter and therefore verification has been completed and the release of data should not be delayed.
    Should NTC not accept this as a valid method of verification then I would suggest the grounds for starting a claim or even communicating with me in the first case are paradoxical and NTC should cease their flawed claim with immediate effect.


    Please be aware that am making this request for access to personal data pursuant to Article 15 of the General Data Protection Regulation.
    I would like you to be aware at the outset that I expect a reply to my request as required under Article 12, failing which I will be forwarding my inquiry with a letter of complaint to the Information Commissioner’s Office.

    The part about identification verification is in response to a line on that page which reads "To follow up with your request we will need proof of identity before providing you with information that we hold on yourself.".



    And a SAR for BW Legal:

    Missed this before posting my drafts.


    Luckily, there was little craft nor effort involved in the Ctrl+C/Ctrl+V'ing for the additional SAR to BW Legal. Happy to cull if not needed.
