Letter in the post today saying that the Court has my defence, it's been forwarded onto NTC 'or their representative' (so it's gone to BW Legal) and that they have 28 days to reply.

Not a very interesting update. But I said I'd keep them coming as and when..

    Cheers all.

    Hi

I've had a little one-liner letter in the from BW Legal which reads along the lines..

"We've seen your defence and spoken to NTC. They want to continue the claim. We've written to the court to let them know."

(I've misplaced the letter so cannot quote word for word.)

When I log into the MCOL portal it says the last thing they received was my defence?

    Any ideas?

    Cheers, GreenSheep

Standard template at this stage. MCOL are many days in arrears with their work schedule.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

    Standard scare tactics from BWLegal

1: They go to court and with a poor case and using a "green horn" legal .... THEY LOSE

2: They discontinue as they know they will lose

Get a really good defence together and your costs schedule

    Hello

I've received a Directions Questionnaire (Form N180) in the post.
    No problems filling this out.

    Quick question...
Can I scan and email the completed one to the same address that I sent the defence to? And can I email it to BW Legal too?

    Cheers, GreenSheep

Yes - is the answer to both those questions.

    Tiny update...

I filed my DQ quickly by email.
Checked on the MCOL website and it now says "Your claim was transferred to - LOCAL COURT- on 26/06/2019".

I guess I wait now to hear from them?
I've heard nothing from NTC or BW Legal. But I have started to gather my supporting documents for a trip to court. I'm actually looking forward to it...!

I'll be back with more as I get it.

Thanks for your help. Enjoy the sunshine.

Yes, wait for the Court date, which will also give your WS and evidence date.

I am enjoying the sunshine by the sea, lovely here!

    Hello
I've received a court date now and a date for the submission of my defence.
Is my defence just basically resubmitting my initial response and referencing evidence where necessary?
    Thanks for your help.

You have already filed your Defence.

As Coupon-mad said four weeks ago, you now need to create a Witness Statement and gather together your evidence.

I think you need to read post #2 of the NEWBIES thread again.
