Legacy / old ESA is what CAB advised me to claim !!
Then you do as CAB suggested? Post 142I am not familiar with the terminology of the forms which are used for this process, but if you have0 not already done so, you should contact the Jobcentre to request a ‘credits-only’ claim for ESA.0 -

You are wrong - if you download the .pdf file and read it - you will see that it requires your spouses details on it - as well as your own - the old legacy ESA was just for the claimant to fill in !
The form (ESA1) is for new (UC based) ESA.
So no contradiction here !

You've got this back to front. Under legacy benefits, to claim income based JSA you would have had to provide your spouse/partner details because all income based claims are based on joint income/capital. Because 'new style' JSA is a contribution based benefit only it can only be claimed as an individual and no partner details will be required.Information I post is for England unless otherwise stated. Some rules may be different in other parts of UK.0 -

If you chose to apply for a contribution based assessment only you would not have needed to provide information about your partner but if you wanted to be assessed for income based ESA you would have had to.Information I post is for England unless otherwise stated. Please look at the ESA1 form again.
It says (at the top, under STEPS)
Complete the right parts of the form for the type of ESA you’ve chosen. Step 2 For contribution-based ESA only fill in the answer boxes under You on page 1 to 25. Read the notes on page 26 and then go to page 48 and fill in the rest of the form.
So, you do have to use this form - it is for both income based and contribution based ESA hence the questions about a partner.
BUT because you are only claiming contribution based you do not need to fill in the details about your partner.0 -

In that case partner details will not be required but the form will have space for them because it is intended to capture information required for both contribution based and income based assessments. You need to make clear that you do not want an income based assessment. I suggest you also spell out in the other information section that you are only trying to make a credits only claim.Information I post is for England unless otherwise stated.
