NI Credits problem

    Despite my informing DWP that I had over £16k in capital - they persist in requiring proof - which I feel is digging too deep into my privacy - what right do they have to know exactly how much I have ?
    Where do the rules state this ?

    So anyway - I am cancelling my UC claim and trying the JSANC1 route !!
    Capital apparently doesn't come in to it then ..

    Credits only is still a valuable benefit - you are applying for a benefit - DWP can ask you to furnish any information they require to determine your eligibility?

    Yes - but why should they be able to dig in to my finances when the rules state "let us know if you have over £16k" and I say YES ?

    I think the answer remains the same - they can ask you to furnish any information they require?

    I would have thought you could supply a couple of savings account statements to show you are over the £16k limit, I wouldn't have thought the DWP would need to know the full extent of your savings.

    What prompted you to apply for UC when you knew you had too much savings for IB ESA?
    Did you not realise UC was a means tested benefit?

    Going down the JSANC1 route is unlikely to be straightforward. You have already apparently encountered misinformation from your local JC (new style ESA not claimable in a UC area), so be prepared for further problems ahead. Particularly, as you have told us that you have difficulties writing forms and printing information.
    You will need to be persistent, and not so easily deterred by minor issues. I would encourage you to enlist the support of an intelligent family member to help you through this process, otherwise I fear you may not succeed.
    As a starting point I suggest you print of copies of the FoI info to show / read to any DWP employee who contradicts the information given.
    You may also need to be aware of the DWP complaints procedure.

    Thanks - going down the JSANC1 appears to be the only route open to me ........
    I am assuming that CAPITAL has no effect on being able to claim NI credits via JSANC1 ?
    Also - will I still need medical evidence (ie a fit note from my GP) - Or does the JSANC1 form negate this need ?
    The JSANC1 doesn't appear to be "sick / fit" dependent ...

    the reason for having to show how much savings you have, even where they make you ineligible due to being over 16k, will be because for example if this week you have 116k and then next month you say your savings have now fallen to 15k, making you now eligible, you'd need to show how you'd disposed of the 101k. Whereas if you're savings are currently 16.01k falling to 15k would be expected after a month or so.

    Right - so you are confirming my feelings - that having over £16 capital will stop me from claiming credits only NI ?

    So whether I have £16.01k or £50k will make no difference as far as you are concerned ?
