    If you had been medically retired once, then I could see it more.

    Being medically retired twice means it happened once, you managed to work again, you then couldnt cope with that, retired again, yet you are still working.

    Not at all surprising that you are having a medical. Having an illness/disability isnt an automatic passport to benefits.

    Ah but my medical retirements are linked - After being privatised from a Civil Service job - I was medically retired from both simultaneously !!
    And since I was retired (9 years ago) - I am worse

    So really you've been medically retired once, you just had two employers...

    Yes - if you want to simplify it - only not at the same time....in fact 4 years apart

    I was made also made redundant from one - and the other paid most of the payout - but that is a different story !
    It is extremely complex
    So lets just leave it as being medically retired once, from two employers !

    As stated in past comments more than once, you still have to go through the same procedure as everyone else. It's not a medical anyway, it's a work capability assessment (WCA). Before you attend this they will send you an ESA50 form, which needs to be filled in and returned, along with all your evidence.

    I remember the ESA50 from 8 years ago - when I last claimed ESA !!
    Maybe this is going to be too difficult and hardly worth the complexity

    Since the person I saw this morning at JCP told me that there was no guarantee that my claim would nor be rejected !

    I was expected to travel almost 50 miles for my last WCA assessment - and DWP refused to reimburse my travel expenses - I ended up threatening them with court to get them - via my MP

    They gave in at the last minute !!

    Why are you continually surprised by this? Of course they cannot guarantee that.

    You are working, so there is every possibility you may be found fit to work and not to have 'limited capability' for it. There is also every chance you will qualify.

    A medical retirement from one job 9 years ago means you were medically unsuitable for that job only. It doesnt give you carte blanche to be unsuitable for any job ever again. You know that. You have a job.

    I am surprised by the fact that DWP does not have set rules about who can and who can claim whatever not just dependent on a WCA - Yes, I do have a job - working 10 hrs per week and sometimes struggle to do that - so feel that if they expect me to do more - I will give up my claim for NI credits !
    9 years ago - I could still walk a mile or more - that, unfortunately is no longer the case !
    my mobility has deteriorated to the inability to walk more than 100 yards
    and thats only mobility discussed - I had a head injury 28 years ago - that has affected me ever since
