    Hi people thank you for you comment's and thanks for showing me how to subscribe to the long haul thread !!!!
    Can I just ask all of my debts (apart from overdraft.... are pre 2005) I was looking at unenforcable debts and well confused, is there anyone that has done this, and if so how have you got on...I'm tempted but it looks hard and considering I have been in a DMP for 5 years there seems to be no light at the end of the tunnel.
    I'm okay paying into my DMP and Payplan are great..and it is now the normal monthly thing so is it a chance to rock the boat you think?
    Not sure with all that I have going on at the moment with my medical assesment and possibliy being medicaly retired I'm not sure if I can hack going through the endless phone calls, and threatning letters.
    It's been great on here for all the support I never thought I would feel as if I'm not alone anymore....and....I know I'm not.

  • Well i have no experience with it but i think if the majority are with dca's you can start by following the flow chart see what happens, if it means your debt free by 2025 it might be something to consider... just dont pick up the phone :D and maybe there is a letter you can send to have them stop calling if they do.. mouseann's thread is a god send i think she has over 100k wiped off her debts :D and none are enforcable xx

    Sorry to hear you've had a low period, hope following your dream makes it all worthwhile! Sounds exciting (OK being nosy really lol)

    Good luck with the budget! I've just found myself fortunate enough to have surplus to pay extra on debts and hope to make my debt free date even sooner than the 3 years I have so far been aiming for :D

    Been on a spend-fest this past fortnight. It started when I walked past a shop window and saw my reflection and was really shocked. I didn't recognise myself. Overweight, drab, shabby clothes and I definitely needed a new bra! I've not bought new clothes for almost 3 years. So I've bought some clothers in the sales. I've also joined the Tony Ferguson diet - available in Boots. So far, I've lost 4lbs, so starting to feel good about myself. I hate myself enough for letting my debts get out of hand - can't let the rest of myself go as well.

    What was different with this "shopping spree" was that I went with a notebook and calculator and worked everything out before hand and immediately updated my online spending diary before I even tried my clothes on! :)

    I've just been trying to sort out my debts, as always! Shockingly think debts have gone up 1k due to balance transfer fees :eek: but think that it should reduce my dfd by another year, so overall has to be good I guess :p Still no Talisker? :(

  • Morning all! Hope everyone is in good spirits?

    Am after some advice, if poss please? I have complained to the FOS re my bank charges with Lloyds (£30 for going 11p overdrawn, struggling a bit to get by after a c-section & on benefits, which were all wrong as well!, struggling to pay the £30 and going overdrawn again by mere pence a few months later, with another £30 charge I could not afford, resulting in more charges that I still couldn't afford) and with Woolwich (who I offered to pay £100 when that's what I owed, in £5 weekly payments, but was told I'd have to take 2 years to repay 5 times as much!!).

    The FOS have written back, with info of the 2 people dealing with my cases, and asking if I have any more evidence I'd like to submit. Now, I followed all of Martin's advice when filling out the FOS forms, downloaded and used ideas from his Word Document, and put my side across, that I had no help from either banks when I was really struggling, that even when I attempted repayment plans, interest charged was more than I could afford to pay back etc.

    I'm paying off the Lloyds overdraft (the amount I feel I actually owe, ie minus charges) at £20 per month and £1 per month to 1st Credit for the Woolwich debt. The Woolwich debt is so old it's not even on my credit report. I'm nervous that the FOS will not uphold either of my complaints and I desperately need to reduce my debts.

    Q1) Is there any more supporting information that I should think of sending? I sent what proof I could that I had been unable to keep up with bills etc because of the overdraft charges with Lloyds ie I was in financial hardship. I also sent info of the convo I had with Woolwich when they wanted £500 instead of £100 and think I even photocopied the letter they sent me regarding this.

    Q2) If I challenged the Woolwich debt through CCA requests and 'unenforceability', could the debt be put onto my report after all this time? I am thinking yes, of course, and don;t really want to go down this route. This debt is one of my biggest and the hardest to pay off :(

  • It should be on your credit file if it's been actively paid, how much do you owe them? Maybe post on main forum with that question and someone can help better, If you sent everything you felt you had to prove your case I do not know what else you can send, see what others think. Good luck x

    It should be on your credit file if it's been actively paid, how much do you owe them? I owe Lloyds Overdraft £1,230.83; Woolwich charges £1,496.75

    The debt company my Woolwich one is with have just offered to wipe the whole thing for £150, so I'm going to borrow off a friend a pay it so it's one less debt to stress about.

    I shall re-open the Lloyds file this afternoon and do some more research online and then ask my question on the main forum later if I need to. I feel maybe I have sent everything I can, but I'll check to be sure as I really need to reduce debts as much as I can and really fear the FOS rejecting my claim.
