Ukcpm ignoring my appeal what to do?

    doing the SAR helps you to get your ducks in a row and is part of your prematch warm up
  • So ukcpm have replied to my sar request, it just lists the type of information they hold doesn’t actually detail the information. Should they have sent me the actual information as in copies of the letters and pictures taken?
    Says they have a copy of my appeal rejection letter which is interesting as i never received it just constant demands for money.

    if you asked for copies of all the paperwork including the NTK and pictures and everything else we recommend (signage , landowner contract , map of the site including signage location etc) then I would say YES they should have included it

    so contact their DPO again and request copies of all of that stuff, including ones you havent seen, thats the whole idea of the SAR

    if they dont or wont then report them to the ICO for failing to include all the paperwork etc

    if you didnt ask for said paperwork, that is your fault for not asking


    so not just a list, but copies of everything on that list, especially the NTK and any rejection letter
  • I used information from the newbie thread and believe I asked for all evidence that was being used against me copy of contract with landowner all photos etc, i am away from home at moment at work so cannot post a copy of the sar I sent, when I’m home will post a pic of the sar and there reply.

    The SAR relates to all personal data held about the requester. It does not include (as a Freedom of Information Request of a public body would include almost anything) other tangential issues such as signage, the contract between the PPC and the landowner - or similar.

    Firing off SARs must be clinically guided and expectations of outcomes realistic.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

  • Ignore my last post I have just got home from work and they have included all the evidence they are using against me, my wife only sent me a photo of the letter and didn’t tell me there was all the other paperwork with it.
    There is a copy of the appeal rejection which I never received but guess there is no way i could prove that.
    The only things I can see they have not sent are the plans and contract between them and the land owner, evidence that they have paid a debt collector and correspondence with dvla to obtain my details.
    Shall I chase these up or sit tight and wait for a claim form?

    Yes to the debt collector correspondence and DVLA request and DVLA response since they will both contain your personal data.

    Copies of the signs and landowner contract are required to be provided to you by either Gladstones or UKCPM as part of the pre action protocol, (PAP).
  • Your proof is your witness statement that you never receievd it
    YOu would ask them where is their proof it entered the postal system.
  • A note of caution on DVLA request/response, you stated that you had moved but not updated your address with the DVLA. Given that is a legal requirement to update that data and the PPC would only have got your data through a bulk request with nothing of any real relevance for your case in it, why would you want to scratch at that particular itch? No benefit to you but may (albeit very low risk) chance DVLA becoming aware that you failed to update keeper details.
  • Well the car had major failure not long after and was waiting to be towed away and scrapped so the logbook was just sent away when car was removed. So it was always in my name but was never registered at my new address so wasn’t done intentionally.
