Parkingeye fine - Aire Street Leeds

    ParkingEye advise they offer a grace period of 10 minutes "OR MORE". As per reasons given in original appeal (poor surface, cars parking as and where they can due to no bays, queues to get out) the 15 minutes spent deciding whether to accept T&C's in this car park fall in to a reasonable grace period. This was also agreed by "Jamie Macrae" on a recent Popla appeal #### also for Aire Street, on the same evening (DATE), which was granted successful as it was agreed that the 16 minutes that driver spent in Aire Street was in a reasonable grace period. There fore an appeal for the same date and time for 1 minute less must also.

    The pictures in the evidence pack are 2/3 years old. As shown by photos in the drivers original appeal signs have been removed/ heavily grafittied since these pictures were taken. Also ParkingEyes picture does also show the rubble around the site which makes it difficult to manoeuvre.


    I would also like to draw attention to the "contract" supplied in ParkingEye's evidence pack has been scanned and sent in such a way that it is completely illegible so T&Cs with landowner cant be read at all.


    I would also like to draw attention to ParkingEyes evidence showing where they alledge the majority of signs are (back wall) are in fact as stated in my appeal behind/obstructed by vehicles. Again as stated in appeal they cant be read clearly. It is not acceptable to show stock pictures of a sign. This does not show them as the driver would see them. They have also not shown images of the signs, which are unlit, in the dark as it was for the driver.

    Evidence has been given that the driver did not accept the T&C's, left within a reasonable period and found alternative parking, of which evidence has been provided in terms of parking receipts.

    You could add some words POPLA use themselves:
    The "contract" supplied in ParkingEye's evidence pack has been scanned and sent in such a way that it is completely illegible so T&Cs with landowner cant be read at all. There is nothing to show when it expired or that the contract continues into perpetuity.
    Is the contract with Elite Parking? If not, who? Elite Parking are not the landowner.

    Elite are not the landowner, they are another parking firm! Say that too!
