    next steps please

    1. Wait until 17th Feb and check if the fee has been paid and come back then.

    2. Check the date for the exchange of Witness Statements which should be 1st March or 14 days before - but check

    3. Start reading about UKCPM Witness Statements as there are plenty here

    4. Decide if you want to go along or have the matter done on paper. You can switch from oral hearing to paper hearing if you give the court 7 days notice i.e before 8th March.

    5. We regards to #4 above you make the decision once you have seen their Witness Statement as there may be something in it you need to challenge in person. These lies mistakes are often easy to spot and usually concern the contract and the signs which you won't see until after the date in #2 above

  • Hello,

    As per advice on here I refused mitigation and also wrote UKCPS a 'drop claim' letter, to which they never responded. I have now received a notice of allocation to the small claims track (hearing) which is mid March.

    It states that the claimant (UKCPS) must pay £25 court fees by 4pm on 15 February or the case will be struck out.

    I was asked when I get my court date to post on here for assistance, is anyone able to help with next steps please? It will be much appreciated.

    Both parties have to send a WS to the court and to the other side usually 14 days before - but check. This is to allow both parties to decide whether they want to go ahead or not

    It more than likely will be paid as this is the Gladstone's model. They may not pay for a legal rep / rent a mouth so if you decided to have an oral hearing you could be looking at an empty chair on the other side.

    The way to take advantage of the Gladstone's model is to starting adding up your costs and have a list of your costs attached to the Witness Statement.

    This puts Gladstones in the position of

    a) paying a rep to defend your costs positions so make it huge
    b) dropping out which they don't normally do - so put in your costs as early as possible
    c) Go along and win and get your costs for them messing you around. Some nice costs win this week so worthwhile doing.

  • When you refer to costs do you mean time spent fighting them / time it would take out of work / postage fees etc?
