CP plus are part of the "ranger" group of companies and provide back office facilities for a lot of companies , they CLEARLY know the rules , https://bmpa.zendesk.com/hc/en-us/articles/203732991-CP-Plus-Ltd , butb are taking the *ee with the DVLA

getting a company like ranger sanction points (multiple times) would close a lot of PPCs down overnight

Have kept the above info for when he replies but have gone with your template pappa golf.

The next deadline from the cowboys to pay is approaching so I am going to contact again to request a POPLA code as per (post 78). Don't want to miss the deadline for this!

as you have already been informed , only the train co can start court action , and within 6 mths of the incident

if cp+ have gained your info from the DVLA they are not allowed to pass it to a non AOS company , doing so is like doing a "mil" (look up MIL cases) , and I think the DVLA / BPA would have to act

let the DVLA dig themselves into a corner , by law (pofa2012 ) you should have recieved a POPLa code , upon appeal failure , no iffs or buts , they are members of the BPA and HAVE to issue one my LAW

As in, have I contacted the BPA to say that no code has been given?

If so NO, I haven't contacted them.

I did read on the POPLA website that if no code was given their advice is to contact the PPC and request again

the rules under POFa 2012 are that if a parking Co that is a MEMBER OF AN aos USES THE dvla TO GAIN INFO FOR A PARKING INCIDENT , THEY must ISSUE (bpa) A poplA CODE NUMBE4R IN ORDER FOR THE "ACCUSED" TO seek alternate independent appeal

at no point should the OP have to ask for this , it is written in POFa 2012 and cannot be overridden by the BPA or any other party without having UK law changed

I gave advice way back in October last year about complaining to the BPA and DVLA. I rarely repeat stuff.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • @ Keith P - haven't sent yet, wouldn't get a reply till working days anyway. not sure if I should contact them now or just ignore on the basis that they have not followed guidelines. Although I fear that would not be the best course, if I were to follow them up in the long run it shows that I did all I can. Also I don't want to miss the 28 day POPLA deadline!

@ Umkomass - I know you have advised this already, although I was waiting to hear back from them so I had specifics rather than speculatively sending something. I have already sent a message to the DVLA and will finalise one to the BPA shortly.
