That is a very good question and one the DVLA seem reluctant to answer.

well I used the word criminal , to actually mean de regulated , as in council type tickets , ones that you can be taken to "real" court for

Interesting!! Surely there would have to be legislation allowing this though? Or is this in place already?

they are supposed to use the correct forms dependent on location/and company that they bare working for , in the case of railways , yes they can work , but should hand data to TOC , not attempt to offer bribes

How does that work under data protection?

Surely they are not allowed to hand over data to the TOC as in my situation?

correct , they sign an agreement with the DVLA to say no data will be passed to non ATA members

this was posted on another site yesterday

I've been complaining to the DVLA for ages about Indigo creating a mish-mash of contract and Byelaws enforcement at station car parks. As it happens, this afternoon I got an email from a DVLA Compliance Manager which, in amongst all the usual blah about taking such matters seriously, says this:

"Indigo Parking have advised that they are not and have not for a number of months been requesting data whilst they are investigating this matter" .

Had the letter from the DVLA this morning. So seemingly it was D-R-P who have collected my details form the DVLA on behalf of C-P- -P-l-u-s on the 28/11. That makes 34 days since the alleged date so beyond the 28 days as set out.

So I guess this comes down to 2 points, the DFT decision - No person other than a court can impose a fine for a Byelaw offence.

    OR

This is a civil matter for which they are sending me begging letters dressed up as fines imitating a level of authority they do not posses!

Will have to wait to see if I hear more from either of the clowns, as recommended though all correspondance from D-R-P will be ignored!

Perhaps you should write back and ask them to confirm that it was for a breach of the terms and conditions of parking and not a breach of a byelaw.

it clearly say breach of parking , but then it states railway bylaws , DR+ have no connection or authority to obtain info for a bylaw offence
