Hi Can someone please help me

I have received a letter from “MIL collections” dated 6/10/17 stating further action -
MIL claiming I have 7 days to pay an unpaid charge of £100 for parking in the wrong bay on private land , then I have another letter dated 12/10/17 which is from car park management services stating they have sold their interest in the debt to MIL , I am not sure what to do from here , up until now I have ignored any letters from this car pArk management services & zenith collections , and now i have received the letter from MIL collections saying I need to pay them £100 or further action will be taken , please could you advise on what I should do ,

Show that letter (the purported 'assignment' one) to David Dunford, plus the Letter before Claim (is that from MIL?) and ask him to confirm that the data they are selling between them is in fact data that originated from the DVLA. As such, why are MIL using it when it's in the public domain already that MIL and parking operators were warned that selling DVLA data is not allowed under the KADOE.

Ask if the DVLA have given the original parking operator, or MIL, consent to sell on this data, and if they have, why were you not consulted/advised by the DVLA?

If the DVLA haven't given consent for MIL to buy/assign this data, what are the DVLA going to do about this matter?

You ALSO need to draft a response to the LBCCC, like Nosferatu told you. Loads of examples on claims threads this week! Show us that draft and it must talk about the new CPR pre-action protocol from 1st October 2017. Don't ask for a link; find that referred to in LBCCC threads already discussed this week umpteen times.

HTH - also please tel us, is the purported assignment letter in exactly the same font and appearance as a MIL letter that you have? Same QR Code and any lower case/spelling errors?

And in regards to the letters , no they are not in the same font however they both have the same small code on them “322a” , and I have noticed on one letter it states the debt was sold to MIL on the 11/10/2017 but I have a letter of further action from MIL dated 6/10/2017 - so they were Pershing further action before they even bought the debt .....

Obviously not, no newbie would be likely to, hence why I told you where to look and asked PLEASE not to ask for a link.

Start reading other claim threads, search the forum for 'protocol 1st October' of course...

Good spot! Do the David Dunford email first and if you say you don't know what to say, I already wrote what to say!

as they are clearly extracting the £$%^&* with UK legislation , should they not be reported to a relevant body , who would curtail and possibly fine them?

yes I understand the SRA , MIL problems

Its up to the courts to sanction them for breaching the PAP.

yes , but which "body" would implement such a charge to be brought to court?

this would be a criminal offence , not a civil one ,

the police may or more than likely may not take any notice as it is fairly difficult for them to take in interest in private parking charges. However, they have taken an interest in at least one case I am aware of recently
    Which body would that be?
Not the SRA, as this is MIL

Its up to the courts to sanction them for breaching the PAP.

Could try reporting them to the FCA - pointing out there failures to comply with requirements when pursuing other non regulated debts

    +1

As regards MIL and the DVLA, that decision appears to be in limbo for various reasons and MIL are using the time when the DVLA's hands are tied to make hay. So expect a few more of these.

FCA is way too busy working out what to do with actual regulated debts - such as PCP - in the auto industry to give 2 &!$£ about this.

So FCA to busy with PCP and HMG too busy with Brexit. Looks like is is up to MSE then. (Translation available)

OK, now look at replies to an LBCCC which mention the 1st October CPR for debt claims.

Threads like yours, with a reply already written, can be found by searching the forum for '1st October CPR debt'. Copy & adapt one and show us. You can do this, just read some threads!
