    Good point about a shop front area quite possibly being Local Authority land, as in the Dawood case:

    and confirmed in my general area of West Sussex too. Councils can issue tickets on such land which is often thought to be private, but isn't:

    So ask the Council for the definitive map of where that road falls and whether the footpath/shop frontages fall within their Traffic Order. Normally 'public highway' covers property boundary to property boundary (e.g. double yellows restrict roads from wall to wall, or defined boundary to boundary, not only within the road between the lines).

    The Council have to provide such a map to any interested person. It might be already linked in their website if they publish their Traffic Orders there, the traffic enforcement map/boundary might be easy to find. If not, just ask the Highways Dept.

    DON'T write (too slow) and DON'T ask under 'FOI' (far too slow!). It's publicly available information, not FOI data.

    I have now sent the letter and will await the response.
    I drove past there last night and noticed some poor soul had left their car there.
    Snapped a pic of the shutters down.
    Unlucky for them as if they are still there this morning which they are
    He most certainly will lift the shutters and issue them a ticket.
    It's disgusting that he is allowed to do this and get away with it.
    It must be illegal? :mad:

    Absolutely, see if you can film this being done one morning. A Trading Standards complaint is vital.

    What about tipping off your local newspaper, search to find a journalist who has written about parking matters before.

  • Don't know if this is relevant or not but as that shop/company was only incorporated on 28/09/17, I wonder who UKCPM had a contract with on 01/09/17?

    I realise the shop probably rents/leases the premises but ......

    Just a thought.

    Hi yes I believe he's just recently changed over the business type and name.

    From what I saw there appear to be two business there, the business on the boarding above the shop and the business scrawled in the window ... either could have contracted the PPC but without demarcation lines outside the shop front and better photographic evidence I can't see how they are possibly going to have a particularly strong case in court - that's not to say they won't try.

    This whole situation is a joke...... I've spoken to trading standards today. They were quite interested in the whole shutters up shutters down thing. They will be paying a visit on that basis. Anything else has to be done via cpm and I need to call the councils planning departments re pavement and landowner rights

    You might want to raise a complaint with the IPC with regards to predatory tactics
    14. Predatory Tactics
    14.1 You must not use predatory or misleading tactics to lure drivers into incurring parking
    charges. Such instances will be viewed as a serious instance of non-compliance and will
    be dealt with under the sanctions system as defined in schedule 2 to the Code

    The issue here being if Trading Standards thinks it is predatory and the IPC complaints system doesn't ... then you can bounce this higher.
