Hi to all, yes i'm a newbie lol yet i have stalked MSE for years. Its always provided beneficial help and advice.
I have a strange and somewhat pathetic story to tell and hope it can be resolved....
Here goes... sigh
I came home today to a PCN issued on the 3/10/17 and dated 1/9/17 with the time 12.50pm Firstly is this within timescale???
I never had any other notification until today. £100/60 if paid in 14 days
The location is a shop frontage.
Yes the gentleman does have 2 signs up in his grubby graffiti-ed window ... no parking at anytime......
Gentleman has allowed drivers to park there on many previous occasions with permission.
I've noticed
not only is he claiming the whole frontage outside his shop. He often parks in front of other shop fronts to free up his spaces and limit spaces to others.
Now the picture on the notice is hilarious, i reckon its a self ticketing type.
would so say CPM get out of their vehicle to take one really bad picture via a dirty shop window. What about front and back pics, I thought there must be at least 2 pics?
Isn't the reg plate supposed to be on clear display in the pic?
So in the picture it shows my car, not very clearly as the pic has been taken from inside his shop. Through the grime and graffiti on the windows you can just make out the full reg number and to the right of it the parking sign stuck to the window.
Please note:
There are no allocated parking bays outside any of the shops and on the road its 1 hour max with no return, which the taxi company abuses.
Now the gentleman has a double fronted window so he claims the full length of that frontage... fair enough.
Yet in the picture my car is only slightly over lapping his window by a few inches, with no marked bays i think this is petty.
Please feel free to correct me if i'm wrong which i'm sure some will.

Firstly Remylou, [STRIKE]edit your post[/STRIKE] you need to re-write your post to avoid giving any clues to who the driver was.
And there simply is no need for all that story.
You are the registered keeper of your car and a driver of it has parked in a restricted space and you as the keeper have received a PCN - a Notice to Keeper.
The driver had the landholder's permission to park there, so your first action should be to tell the landholder to call off his parking dogs.
What is the name of the parking company?
You now need to read the NEWBIES thread.
The first post on that thread tells you how to appeal to the car park operator.0 -
Done, I have read the newbie thread and made best sense of it what i can.
However i was trying to find out if all was still applicable especially what with the ridiculous photographic evidence before i refuse and appeal:):).

... so the driver was only parked in front of a bit of his window front? The fact there are no marked bays is another point in your favour if it went to court as you can say that the area of the "parking restrictions" was perhaps not clear.
Anyway, all that being said, you have a PCN. The PPC giving it to you are an IPC member so follow the Newbies thread advice and appeal as the Registered Keeper (at the appropriate moment) using the template provided. DO NOT name the driver or give away whomever that would have been.
Then unless you can get it cancelled by the landowner (doubtful if that is the shop owner) then you are in a waiting game to see if the PPC take you to the Small Claims Court in the next 6 years. You are looking out for a real Letter Before Claim (from a Solicitor) or a MCOL (from Northampton County Court). When you receive one of those you come back here and construct a defence, submit it and hopefully win the case in court, then it is finished. In the intervening period you will get lots of correspondence from Debt Collectors (as per the newbies thread you can safely ignore them - but NOT a LBC or MCOL as said above) which you must keep as evidence safely. In fact keep ALL correspondence do not throw anything away.
I suspect if this is a self ticketing site the shop owner gets a commission for each paid ticket from the PPC,
Actions for you:
1) Read the Newbies thread
2) Read some other recent threads on similar situations
3) Submit the IPC appeals template as-is (DO NOT reveal the driver ever)
4) Come back with any other questions or if you get any further correspondence that you think may be a LBC or MCOL
5) Gather your evidence, get a recent photo of the parking area, the signage and the surrounding areas. Do this soon as in years time if this goes to court it may all be different. You want evidence of it now (when the alledged contravention took place) to rely on.0 -

Yes it was a self issues ticket I guess.
And look what I discovered the other day
He only has no parking signs in his shop window.
When shutters are down there are no signs.
Whats to say he leaves it down to lure parkers then pulls it up to snap and make money?

no , I am saying that if you are not paying in full you have the right to challenge the invoice using the black text template
then you have the right to ignore all debt collector claims and letters
the time to then deal with it will be if or when you get an LBC or an MCOL in the post
ie:- you have the right to defend yourself in court, based on what you have said earlier , until then you dont owe a penny0 -
