    Tesco is RBS Group so hopefully my Natwest one will be sorted soon, given I logged it the same day as you.

    I think tesco is no longer part of RBS. They bought themselves out in 2008.

    New to using forums and hope that I am posting in the right place.

    I have just received a reply from Protect Claims regarding my ATOL protection. They have agreed to refund the holiday cost in full, however I was also claiming a further £108 for seat upgrades that were purchased at the same time as I paid the outstanding balance of the holiday. They say thet as these were extras they fall outside the ATOL protection as they were not part of the package holiday covered.

    I tried the CAA, who said to call Protect Claims, I eventually found there number (not easily identifyable from any correspondance). I eventually spoke to a young man, who said that he would have to check with his supervisor regarding my inquiry and he would return my call within 20 minutes.

    Instead in 10 minutes I received an e-mail re-iterating that they stood by the decision (cowards wouldn't even call me to tell me directly).

    My question is this, does anyone know if this should be covered as without the package holiday the seat upgrades would not be needed, the money was paid to Monarch directly at the same time as the outstanding balance, If I had purchased the seat upgrades at the time of the initial holiday surely they would have been included in the ATOL protection. It was only when I received a winfdfall from PPI (thanks MoneySavingExpert) that I decided to upgrasde the seats. It was not paid to a seperate company for car hire or parking etc.

    Other than ATOL protection, does anyone else know of anyother way of claiming back, I have checked my Travel insurance and again this is baffling (next Stop, when I get chance), also as I paid with a Debit Card,, does anyone know / think that the chargeback may work?

    Did you receive an ATOL certificate after booking your holiday?

    This will often show what is covered and the amount.

    I suspect sadly that as you booked the seat upgrades separately that they fall outside of the items covered under the ATOL scheme. Two separate transactions, one for your holiday covered by ATOL and one for flight extras which is not.

    If the extras were over £100 and you paid by credit card or certain debits cards, you could make a section 75 claim for the credit card, or a charge back for the debit card.
  • Did you receive an updated Atol certificate reflecting the new overall cost attached to your email confirmation of your prebooked seats?

    I added to my flight only booking twice. Both times I received an updated certificate. First time I added priority check in and boarding and then a few weeks before departure I added some extra kgs to the luggage. Both were covered by the Atol certificate.
  • No I only received one ATOL Certificate at the time of my original booking and it states thast the "Package Holiday" is protected.
    This is the crux of my consternation as the seat upgrades were with Monarch and surelly part of a package deal as I couldn't upgrade the seats if they were not part of the package.

  • So you upgraded them direct with the airline or via the tour operator? Possibly if you did it with the airline they wouldn't be covered because at that time the airline weren't Atol protecting. If you did it via the tour operator they should be covered though as part of the package.

    Regrettably you won't get more than the amount shown on the ATOL Certificate so if the added extras don't appear, the CAA cannot pay. You may well be able to make a chargeback but talk to your card issuer as quickly as possibly
  • I think calling them cowards is a bit much - they have thousands of claims to process, and rather than pointlessly argue with you about it on the phone, their time could be better spent dealing with other claims.

    I am having difficulties with my ATOL claim. I have sent the correctly completed form and proof that I paid with my Debit card - bank statement - but "Protect Claims Ltd" who are dealing with these claims are still withholding my payment.
    They claim the bank statement doesn't prove I used my Debit card, and that I must have used a credit card.
    Are they incompetent or just trying to avoid payment.
    I only paid a deposit of £236.00 as a deposit for a package holiday next May, but it's my £236.
    Is it worth taking legal action?

    Look at providing further proof regarding the transaction.
