In an earlier post you said "I work in Criminal Justice"
You will then be able to tell the difference between the Beavis
case and yours and why the PPC is full of cr*p
The same with THE IPC SCAM SET UP BY GLADSTONES
I do. Although criminal justice encompasses many organisations and job roles. I really cannot talk about mine, needless to say it doesn't require intimate knowledge of the law and legal processes. Although I do have a GCSE C grade in Law! Haha. Thank you for the input.0 -
Can i ask how this ended up. I am also a newbie to this and i need some advice on this company national parking enforcment
They also contacted my fiancee as my vehical is in her name. I had parked in a disabled bay with my blue badge displeyed but becasue i did not go into nandos i went next door into majestic wine. As the bays outside theres was full. Anyway i did repley to npe to say i am the owner but due to height of my Range rover the sign for nando was bumper level and i did not see it. I appealed but now they want £100 off me for less than 10 min stay. They told me i lost the right to get the lower rate as i had appealed. I replied by saying i have the right to appeal as i do not feel i was in the wrong. Needless to say i lost the appeal. I have contacted them to say i will ONLY pay the lower fine but they replied to say No. so i now have no idea what to do. The car & house are not in my name so no debt agencey can touch me other than to mess up my credit Any advice offered would be gratfully received. I cant even find out here how to start a new post/thread0 -

What a pity you gave away the driver's identity when you appealed.I married my cousin. I had to...I don't have a sister. All my screwdrivers are cordless."You're Safety Is My Primary Concern Dear" - Laks0 -
Ok guys so after months of silence, I have received a 'LETTER BEFORE CLAIM'. From Gladstones Solicitors:
'We act on behalf of the claimant and we have now been instructed to commence legal action against you to recover the amount due...in the event the outstanding debt is not paid, we are instructed to commence legal proceedings. Our client is satisfied that it has sufficient evidence to support this claim and, if necessary, will rely on this evidence in court...please pay or reply within 30 days of the date of this letter.'
So what now guys? I assumed that it wouldn't get to this stage? Still prepared to fight it. Help, what do I need to do? I have 14 days to reply.0 -

One assumes as they have given 30 days, it's a Letter Before Claim ??
So did they provide proof they are 100% certain of ?
Did they provide pictures, details of their costs etc
Such an odd ball bunch are the incompetent Gladstones.
Fancy saying "if necessary, will rely on this evidence in court"
What the fu*k else do they think they will rely upon ????
Have they complied fully with the new debt protocol ?0 -

This time you need to refer to the second post where you will discover how to react to a Letter Before Claim.0 -
Ok. Cheers. Wow. There is a lot to work through.
They have sent a couple of pictures of a person, which one might describe as fitting my description, as leaving leaving the car referenced and getting back in 3 minutes later. They did include costs (expect £160, £60 of which are the costs claimed by the client).
I am still not sure how I am going to argue this. I will have to research.0 -

Any legal 'adviser' we've seen here in bygone threads has each disappeared, and the best you can generally hope for is unqualified people throwing in their own two-penny worth of opinion. Try those more known to you would be my thinking. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Ok so I need to do a letter to NPE for SAR (although they have already furnished me with much of the information suggested...I guess that another request wouldn't hurt) and a letter to Gladstones.
My defense will rest on the grace period. That the driver read the terms and conditions and decided to not engage in the contract and leave. The stay period was 3 mins (4 mins absolute max) from what I can tell. I am assuming that I do not include any of this in my letter to either party at this stage?
If I write to the landowner...can I include this? Do I maintain the anonymity of the driver? At what point would I identify them...if at all?0 -
If you do, and I recognise what you say about various branches and disciplines, I rather suspect you are much closer to legal advice than posting on a car parking charges site
Thank you, but sadly I am not. I am a civil servant working in criminal justice. I don't have that kind of access or know those sorts of people.Any legal 'adviser' we've seen here in bygone threads has each disappeared, and the best you can generally hope for is unqualified people throwing in their own two-penny worth of opinion.
Eurrghhh. Way to make my stomach turn. This is a big step down from 99% cases being won and it leaves me thinking that maybe I should have just taken the £60 initial fine...or that I should cut my losses and just pay the £160 now.0
