I can not understand why you didn't send a simple one point appeal based on Grace periods. Read the IPC Code of practice and you will see that you are entitled to a period of grace when you can read the t&c and decide to park or not followed by up to 10 minutes after parking to leave.

The former would apply in your case.

But what exactly do they claim you did wrong? Not paid? Parked over 3 parking bays? You can't be charged for parking in a supermarket car park unless you did something against their t&c.

Goddammit. I hope that I have not shot my load too early so to speak. I have already lodged the appeal by email. I wish I had known this key piece of information. I would have included it in the appeal. I guess I can keep it as ammunition should I get to the court stage. As it is, I copied and pasted the standard letter for newbies (IPC).

I already have a response. They are so efficient (whilst misspelling 'you'). Haha! It reads as follows:

Thank you for your email of appeal.

Your state that you were not the driver but unfortunately, you are unwilling to supply an address or name for the driver at the time or date.

Therefore, we are unable to reissue the charge. In view of this we have the right to recover the parking charge from you as you are the registered keeper.

    Regards,
    Appeal Team.

They clearly haven't read my appeal, because at no point did I deny being the driver. Only that I refuse to identify them. I am by no means a lawyer, but I managed to understand that from the template. Am I right in thinking that I resist the urge to engage in a discussion with them via email? Do I just sit back and wait now?

The little side road was next to the shopping area, so it may not have been associated with the shops...not that I believe this was clearly marked in the area that I had driven in to. The reason for the PCN is cited as 'Vehicle Not Registered on Database for Area'.

Right, so reading through your thread, the time has now
come to slow down and think first.

The experts on here including two solicitors know what they
are doing and the aim of everyone is for you to win.

You are in the hands of scammers and for the moment
    this is not going away.
You tried, albiet too early but not a big deal.

YES YOU WAIT ...... despite being harassed in the future by
idiotic debt collectors with the mindset of a monkey, you
    ignore everything

If the PPC wants to take it further, they will and as they belong
to the great IPC scam, it will probably be passed to the most
incompetent solicitor in the UK .... GLADSTONES

THEN .... you come back here for the best advice and help

So slow down and follow the leaders and who knows, one
day you could be helping others

PS: Gladstones set up the great IPC/IAS scam

Thank you for the support. I will sit tight. My template email is the only communication I have had with them. Quite enjoy the battle...although this is based on the assumption that I will win. Thanks for all of your advice so far guys.

Haha...I forgot to mention that I was chatting to an ex-policeman colleague about this today and he suggested a genius way one might appeal private parking PCNs. So crazy that it might work, although I dare not ever try it.

He said one could claim that 'this always happens' that 'an unknown individual has cloned my car and licence plate and are wracking up fines and tickets with their vehicle'. Say that 'this is a recurring problem, that the police are aware and it has been reported on numerous occasions'. The parking company might ask for a CAD number, but one could say 'well that is private information and none of your business'. The DVLA would not hold evidence of this and the Police are highly unlikely to release information confirming or refuting it (if contacted by a private company for a CAD) due to data protection. He believed that the private company would be forced to drop the charge and anecdotally, he had witnessed individuals doing it.

bad news if a court case ensued however, because perjury carries a much heavier sentence (as does perverting the course of justice)

I wonder why he is an "ex policeman"?

    Quality. :)
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Such cases do still end up at hearings. There was a case saved at the last minute after two hearings earlier this year, where Excel misled the court by saying a Crime Number was needed and the Judge believed it, and gave the lady a chance to get it, and adjourned till another date.

Luckily, in between, she found us! There is no Crime Number supplied for a cloned VRN. Excel know this, of course.

I wrote a WS that tore Excel a new one, so to speak, even though I am a ladeeee! The Judge awarded her costs and beamed at her when she turned up for the second hearing, because he'd read the WS and was unimpressed with Excel (the scales had fallen from his eyes):

    http://parking-prankster.blogspot.co.uk/2017/02/flawed-anpr-misread-causes-2-years-of.html

But that was a true cloning case, she'd never even been to Birmingham and nor had her car.

Never ever lie in a court situation, and don't assume a PPC will drop a case when an appellant says any old thing!
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
