I have sent the 2nd letter to MBNA claiming the 2 charges from after June 2006 but without the interest on top. I dated the letter 16 June 09 but wasn't able to send it until 20 June 09. I have just recieve a letter from MBNA stating that they are currently investigating the complaint and will provide me with full response by July 19, 2009? That's a bit off from the amount of days I put on the letter which is 14 days. so can anyone tell me what should I do?

You can take your complaint to the FOS. Send them a copy of both letters.
N.B. Cap One failed to offer me a settlement, 14 days after I requested it. I was in the process of filing a complaint with the FOS then the next day, I received an offer which I accepted. Didn't have to file complaint with the FOS after all. I didn't even send a 2nd letter.

I don't know what to do. I seem to be incurring charges on my LLoyds CC at an alarming rate and have got really behind with my payments, so much so that I now have a default notice on my record.
I want to try to claim my charges back, although from reading on here, Lloyds are not very co-operative anyway.
I haven't sent for my statements/list of charges yet, so don't know how much I will be able to claim. Obviously, whatever I do manage to claim will go towards paying off the CC debt.
What worries me though is that I have a current account also with Lloyds on which I have an overdraft, the overdraft is due to be reviewed in November. If I put in the claim for the CC charges back, are they likely to not renew my overdraft facility as I would not be able to repay it?
I will probably also be wanting to put in a Bank charges claim too, would this be likely to affect my renewal of the overdraft facility?
I have got a couple of other bank accounts, but not with the same amount of overdraft facility, so no chance of moving the debt to them.
As I have now got the default note on my credit account, it would not go down well with a credit score, so unlikely to be able to get any other account or credit.
If I claim my CC charges back, can I ask them to take the default notice off, as it was due to the charges that I got way behind with payments, and at the moment, I am unable to catch up. What is the chance of them taking the default note off the account?
Any help much appreciated.

hiya i recently saw on tmartin lewis website that credit card companys may charge £10 to issue statements in which i was very willing to do.i rang up HSBC, in which i have a bank account with also and asked for all my statements.they told me they can send any 12 for free and after that they would charge me £10 per statement which would have totalled to a few hundred pound.
Is this correct or were they lying to me??

Hi ya, its not the statements that you are requesting its the charges that have been applied. You are asking for these charges in a clear legible manner. The template letter explains this in more detail. In short £10 for this info NOT per statement.

I have a question the Bank Charges can be claimed back to 2001 due to the case being on hold etc.
How far back can we claim the CC Charges is it still 6 years or is there a fixed date?

I believe as No test case yet on Credit cards it will be 6 years back.If you see a penny, pick it up, all day long you'll have good luck !!!!!!0 -

I have sent a letter to Vanquis Card to ask for a copy of any charges applied to my card since i started it.
I had a letter yesterday saying there is no hidden charges on this account card.
I phoned this morning to ask why they had returned my cheque without having sent a copy of any statements and the girl said again it is a no hidden charges account.
I told her i was not asking that and all i wanted was a copy of all statements since i started the card.
She told me the reason the cheque was returned is because the £10.00 would not cover the cost as it's £5.00 a statement.
I told her it does not say anything to that effect in my letter and i want a letter to that effect sent to me or i intend writing to the financial commissioner for breach of rules?
Any advise from anyone and is this normal practise from them in the beginning?

You should not refer to statements (this gives them a get-out), always refer to data. This means all information which will include charges etc. the simplest way to provide that is statements, but it means they can't charge you £5 a popSection 7 – Data Protection Act 1998
