Well it's a very poorly written article but raises local awareness to the cause and a meeting of the 'action group' tonight.

On another note... the payment for my costs on the first claim was due today and no cheque received. They have had the letter of Judgment for at least 7 days.

Should I go straight to an LBA demanding payment within 14 days or just send my first letter requesting payment within a few days?

The meeting was a big success, around 40 people I'd say right? Ooohhhh the things we are planning! :)
  • Indeed, it was a good turn out. Put a lot of peoples worries to rest I think.
Surprising how many are at the CCJ stage though :(

Maybe someone else can answer the OP's question:

There's no LBA required, you won't be suing them, you already have a Judgment against them from the Court, so what's the point in asking for another one?

If they are past the deadline for paying your costs, you go back to the court and apply for a Warrant of Control. There is a fee for this, which is added to the Judgment debt.

This will trigger a visit to their head office by the County Court Bailiffs, who will demand immediate payment, or else they will remove goods to be sold at auction to cover the debt.

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.
  • That's the kind of info I like :)

I'll contact the court today and and apply for a Warrant of Control.

I did see something about it on the Court website with a fee but didn't realise I could add that to the debt so they paid it.

    Thanks again sir :)

Or you could wait until 28 days are up so UKCPM end up with a CCJ on their record; (although, it will be marked as satisfied when it's paid).
  • Castle, that's another interesting angle :)
What would be the process to trigger the CCJ? I wait 28 days then go back to the court and.... do the same?

AFAIK, the CCJ is automatically entered on the register, but if paid within 28 days it will be removed. (Technically, that means cleared funds within 28 days).
