    There appears to be nothing in the Newbies thread relating to a 'set aside' form. Is this something that needs to be download? Or is it a case of writing directly to the County Court?

    Any advice would be appreciated.

    What a crazy situation to get yourself in.
    You knew a court case was looming yet made no provision to read your mail. Ridiculous!

    Thanks. Will the N244 form need to be filled in (i.e. from the gov.uk website)?

    And what happens when a 'set aside' is submitted?

    Have you read post 2, or done the obvious searches on here to understand the process?

    If you werent picking up mail you dont have a very good reason to get this set aside. Youre asking the court to spend more time on your case, when you couldnt be bothered to respond in the first place

    Id pay up, as long as you are within 1 MONTH of the CCJ date. Ensure you get a receipt of payment and file this with the court, to ensure the CCJ is removed from your file.

    You have to have a very good reason for a set aside application to succeed. Not opening/retrieving your post might make it difficult. It will cost you £255 (unless on certain benefits) to find out. If the set aside is turned down, you lose your £255 AND you still owe the claimant the costs awarded against you, which, if you don't pay, is likely to lead to a credit score trashing, and problems for you for the next 6 years.

    How much did the court award against you?
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    ...which includes the OP's statement in support of his/her set aside, and an outcome which included the £255 being refunded. They were in and out in 5 minutes and he/she just asked for the £255 to be reimbursed by the non-attending claimant (quite often they don't attend).

    The court would not ask you to pay anything. Are you sure that is what the letter says?


    If it is a CCJ, and you want to pay it, then you must pay the claimant direct
