Yes but you cannot sell on eBay without PayPal, so you will be giving up your business. Also, a lot of other sites I sell on including specialist forums tend to only use PayPal, I certainly couldn't trade without it.

Its not paypal he owes the money too so while he may be off ebay he will still have paypal

We obviously don't know the real reasons but I worry that if eBay found something that concerned them about the OP's selling practice then PayPal might follow. This would be more likely though if OP used PayPal to pay the eBay fees.

I have no problem with Paypal. I have used them and have been perfectly fine so far.
  • Yeah I usually ignore them.

    Great thank you.
So worst case scenario is that I ignore them, until I get an official court hearing/judgement and from that point I can just pay with no affects?

If I where to pay at that stage would I have to cover the cost of court/legal hearing?

From what you have said above: if it were to go to court you could contest it on the basis that they did not provide the service for which the fees are payment. It is hard to believe that any court in the country would uphold their claim.

And yes: they would probably add court fees to the amount claimed, but if the court found in your favour then you would not have to pay anything.

I have always suspected that the last thing Ebay or Paypal would want is a court looking over their terms and conditions.

There is zero chance this debt will be pursued via court action.

However if you do owe them money for a service they have provided, pay them.

I 99% agree. I would add that things can change and that a change in policy could result in them pursuing a raft of cases at some point. It's also not unheard of that debt collectors buy up small debts and take out bulk claims.
I had something from a few years ago that was for around £50, a disputed amount, company chased me for a but, gave up, debt was sold, company chased me, I ignored them and then had a claim turn up. I defended it but they never even replied, so it was thrown out. From what I know they take out bulk claims in the hope that most will pay up and the rest will ignore it even when it gets to court so they can add costs, get judgement, then either get paid or send bailiffs.

As far as the OP goes, I don't think there's a justifiable reason for withholding funds, the dispute doesn't concern the fees levied.

Yeah its more likely ebay/paypal will give up, but if the debt gets sold on it goes lower down the food chain.

It maybe better these days after people have advice from the internet and companies dodgy procedures gets them a slap on the wrist etc.
But there are still bottom feeders that "accidently" send yout you owe us money debt letter to a neighbour or your works.

Unless you get the court letter though, they can do very little.

Will ebay have claimed the fees from paypal and its actually paypal you owe? They could split the loss between them. But for the sake of £140? You might not be able to use ebay or payal ever again.

If you think that moving is enough, think again. There have been posts where people sneaked back onto ebay, different address, different bank then one day paypal is frozen with your funds.

Thanks, my gut is saying to ignore them until there is a chance of court being involved, but hopefully it wont go that far.

As a seller I have not broken any eBay or Paypal terms (hence why my paypal is still active) After several messages to eBay they continue to avoid the question I keep asking.... Which term did I violate. There are 100's of other users both company and personal accounts selling my exact same prodct and from there feedback have a much higher defect rate. I dont understand what caused ebay to make this decision and I am sure they have there reasons but if they can not justify to me why this decision was made then I can justify to them why I am not going to pay there fees. Treat me unfairly and you get the same service back. Before this I had paid all my fee's, but this is a way I feel I can get back at them for them saying I am not allowed to use there services.

May not be the OP, could be someone linked financially or otherwise has been scamming or otherwise breaking T&Cs and this is collateral damage
