  • Ok, we're not exchanging this week and moving on the 5th anymore. Our buyer is never going to get the amended mortgage deed signed and returned to their solicitors in time.

    We're now going for the 12th, 2 days before our sellers' mortgage expires. RISKY.

    Do you know they can't get it signed & returned in time? Or is that just assumption? What about RM guaranteed next day delivery?

    Well, first they needed it amended because the term was wrong, and the solicitors received that yesterday. But now it needs amending again because of a spelling mistake in one of the names!! You'd think they'd have noticed that/got it fixed at the same time, but no. So they probably won't receive the amended offer til tomorrow now.

    In absence of any update to the contrary, I'm naively hopeful :* our solicitor has managed to convince the others to exchange Monday (latest) for completion on 4th.

    Oh fingers crossed! Our sols won't let us do any shorter than a week, says our lender requires that long to release funds. 

    I was all set to start packing this weekend ready for the 5th, but now the pressure is off again maybe I'll just sit around doing nothing again. I don't really want to start packing til we exchange.

    I wanted at least 5 working days between exchange & completion, but yet again! compromised on Mon-Thur, which is what our solicitor is trying to achieve. We managed 18th Dec exchange & completion 8th Jan on our sale with chain of 4, so I don't know why some solicitors are so insistent on simultaneous or almost, transactions.

    I would have completely freaked out if I hadn't started sorting/packing way before that. In fact some of our stuff has been packed since early December. But I knew by then that temp accommodation was a must, so very different from moving straight from A to B.
  • Arrgh - surveyor was booked in for Monday - they just called me to say the lender has asked them to cancel the visit now. Not getting any answers - what does this mean!!!!

    Just registered a complaint against my solicitor, she has sent literally nothing since I engaged her in mid October, ignores any emails politely asking for an update, forgot to order the searches which should have been ordered in October, so they ended up being ordered in early December, I am a cash buyer, no mortgage, and its just myself and the seller in the chain. All searches and enquiries are done, survey (arranged by me) was done before Christmas, I have had very few replies to my emails asking for an update over the last four months, most have been ignored, the few which I have had replies from are dismissive and generic, she never answers the phone, when I did manage to get through to her earlier this month, the 13th, she was very defensive, and said 'you do know there is a national lockdown' The housing market is still operating, I sold another house back in November, so I know this for a fact! I have no idea what the searches have brought up, what the sellers fixtures and fittings forms say, no contract, no nothing. No idea what the enquiries are either, and I've had enough. its well over a week since she was apparently reviewing the file to report to me, and nothing has been sent. The unnecessary delays, lack of information and communication, and completely absent customer care and service is diabolical.
     I emailed my solicitor yesterday afternoon, and copied in the Director and Director of Operations, within an hour I had an email from the Director of Customer Care, who is looking in to the matter, funny that! I just want to review the file, and get the contract signed to set a date for exchange and completion. Let's hope that there aren't any issues that I am not aware of! It would be nice to have some information on MY transaction! I am absolutely livid at the way in which I've been treated and this was made clear in my email yesterday.
    Making time for me now. Out with old habits and ideas, and open to change......:j
  • I am in the position that as far as I know everyone is ready to exchange. Estate Agent is pushing for dates. Solicitor seems very laid back about this and seems to be reluctant to commit to anything. My suspicion is he's putting exchange off because he has too much work on so cant fit it in. What would others do in this situation? Specifically, how often would you be hassling him. Last spoke in Monday and have just been waiting to hear ever since.

    I would just send them an email saying the date you wish to exchange and for them to respond if they foresee any issue with that from their perspective.
