  • So, I didn’t think I would be on here as with all the doom and gloom about houses I thought I’d be waiting a while. Our house was put on the market 21/10, we had an offer but they hadn’t sold so our estate agent kept it for sale. We accepted a FTB offer and we are now SSTC but we haven’t found a house, there’s nothing available for us, so inside I’m panicking in case no houses become available. We are moving in with our son if we don’t find anywhere, which I’d rather not do :). Hoping it goes at a normal pace not a speeded rate :wink:

    Thank you all so much for your well wishes! We managed go get hold of the keys post escape room, and removals (take 2) are booked for tomorrow morning.

    @sophieo16 - this is exactly what they're likely to do. I work for a conveyancing solicitors and if you exchange this week they will send the lender the deed to get the funds released in time for an early January completion.

    So, we were meant to exchange today but as usual the Vendor decided to throw a spanner in the works.

    The house still hasn't been cleared out of all her old stuff. She originally said she was doing it last weekend then changed her mind. She is insisting she wants us to exchange before she will do this "in case she needs any of it", bear in mind all of this furniture is cheap 30+ years old and will likely fall apart if you breath on it, but her stance is, if we pull out of the sale she will need to re-let the property so needs the furniture for tenants, which I truly don't understand as no right thinking tenant would want any of it anyway and it's more likely to put perspective tenants off when they're told they have to live with it. Besides, if we were going to walk away we'd have done it long before this point!

    Due to her being less than honest with us (proven) more than once, our Sol responded to say in that case we want a retention of funds held in case she doesn't clear it all and we end up having to get a house clearance company in. She point blank refused, sending a very stroppy email to her Sol basically stating we're the ones causing the issue and that she is definitely going to clear it all out so there is no need. Our Sol went back and pointed out that if she has every intention of getting it done then she shouldn't be worried about a retention of funds because it won't be needed if the house is indeed empty of all her belongings. And we're not talking the odd lamp shade here, we're talking wardrobes, multiple chests of draws, washing machine, fridge, all sorts of stuff. This went on all afternoon with the Vendor arguing the toss. In the end our Sol basically said no retention, no exchange, your choice, and so she reluctantly agreed, but our Sol was about to finish for the day by then so she told the Vendors side to get the draft retention doc sent over and we'll review and exchange tomorrow.

    Fingers crossed it goes ahead tomorrow and we can agree to a completion of 6th January.

    meant to be completing tomorrow and have the funds but still not exchanged! feeling very anxious as now can't get through to our solicitor at all.

  • I'm back in limbo-land.

    Adverse possession claim has received a response from title-owner but we don't know the nature of it. Seller's solicitors who are handling the claim are in touch with the title owner directly, and have let us know that, but didn't allude to the nature of the contact.

    Whatever happens, I think the statutory notice will have to expire before anything can be done about it, so will still need to proceed and buy the property without the contentious land. Seller's solicitors still haven't responded to our idea of a retainer to be held until the land issue is sorted.

    Desperately wanna know where we stand before the Xmas break as I'll inevitably be flooded with questions from family as to when/if we're moving back up. I can't handle the anticipation of not knowing.

    Well done to everyone who's managed to get some results. I wasn't expecting any before Xmas but was aiming for an early Jan exchange and complete. That might get dragged out at this rate.

    That’s so frustrating.  I too like you wanted to at least have an idea of when things might happen before Christmas but doesn’t look as though we will know anymore.

    I haven't heard anything today but I'll chase tomorrow afternoon if still not heard.

    Due to exchange by the end of the week and complete on 9th.

    I've said if we don't exchange before Christmas then I'll push it back to the 16th as I'm not being rushed lol.

    I'm viewing another on Friday that looks lovely so fingers crossed it's a winner.
