  • Not that she would be more clued up on damp bit she had lived there for 5 years previous so she would have been able to tell me of any issues she may have had. That's why I asked her. We will have a look around for a quote for someone to come an have a look. Thanks for the advice
  • We reserved our new build at the start of June and still haven't exchanged. We're being harassed by the developers to exchange contracts as soon as possible, but our solicitor doesn't seem to be in any rush.


    We've signed the contracts and he applied for Help to Buy Authority to Exchange on Tuesday last week (after a bit of prompting from us). Hopefully we'll be able to exchange this week. Just feels like it's been dragged out for way too long.

    We've been waiting to exchange for about 3 weeks. Everything ready on our side and from minimal contact with the sellers side everything's ready with them too. Literally don't understand now what were waiting for- it's getting so frustrating as myself and OH have each booked time off work next week which it seems is now going to be wasted 😥 Our solicitor is absolute crap just blames the seller every time. Maybe someday this year we'll have a set of keys!

    I think this is actually a misunderstanding of 'vacant possession' by your sellers - they thought the property was chain free when it isn't. Vacant possession means the property is empty on the day you complete, which is most purchases (unless you are buying as landlord an already tenanted property or in some exceptional circumstances), chain free is what they thought, which means the sellers weren't also buying another. Or of course it was a case of misrepresentation.


    It's really annoying when a chain free property turns out not to be, it's happening with us right now.


    Options are to wait it out (how long is a piece of string), for you to look for a new house, for your sellers to move in to temporary accommodation or your sellers sellers to move in to temporary accommodation. We've just had agreement our seller will move out in to temporary accommodation, but until exchange she could change her mind!

    Yes, sorry I should also have put chain free. It was advertised and told all along if was chain free and vacant possession on completion.


    Waiting it out is preferable for all of us. I just can't believe on the day of exchange this only comes to light. My vendor and the person at the top of the chain are making a formal complaint to the Ombudsman.

    It's really irritating isn't it. I can't believe they waited until exchange to say something, that's beyond the pail.

    I'm just waiting on local authority searches to be returned now. Once I have all the searches and responses to solicitors queries, I should be exchanging right?

    I just remember a lot of paper work last time I bought, and I haven't had a scrap as of yet...

    Once all that is back you'll get a conyenancing report - which is all the paperwork! You can then start talking about dates, but that is obviously dependent on other parties.

    thanks Rambosmum, appreciate the info. I'm honestly starting to think I'm going insane, I can barely concentrate on working because I'm too busy checking my flippin email to see if they solicitors need anything!
