  • I am approaching 80 and am trying to tidy things up. 
    I currently own a house, with my wife, which we purchased in 1982 which is unregistered and held as tenants in common. We subsequently purchased a small strip of land from a neighbour to erect a garage at the bottom of our garden which is registered land and is held in joint tenancy. It seems sensible to register the house and combine the two titles. There are no mortgages outstanding.

    The house was changed to tenants in common for IT reasons, but I understand this is no longer necessary, so it would seem logical to change this back to joint tenancy as I assume both pieces of land would need to be the same. The only articles I can find online to change the tenancy refer to completing Form SEV and sending it to the Land Registry. Does this apply to unregistered land or is the process different? Is this something I could do myself? 

    Once this is done, then we would want to register the house and amalgamate the titles. Again is this something I could do myself? It appears to be relatively straightforward but I can't find any examples of filling in Land Registry Form DL - the house dates from about 1875 so there are quite a few documents - I'm not sure how much detail is required.

    Thanks for any guidance you can give.

    We don't deal with unregistered land/property so there's nothing for you to change re your TIC for example as that's simply a term used to describe how your beneficial ownerships are held.
    There is no need to register and then amalgamate the two titles. It can seem sensible but many properties and land are registered under more than one title and there's nothing 'lost' or stupid about that being the case.
    The sensible thing to do, as you are in a tidying frame of mind, is to apply to voluntarily register the property - see PG1 for guidance First registrations (PG1) - GOV.UK
    Form DL is simply a list of the deeds/documents you are submitting in chronological order from oldest onwards
    If on submission you want to ask us to amalgamate the two titles then you are correct that you need to provide evidence to show how you have changed from TIC to joint tenants re the unregistered property. That will all depend on how you changed to TIC originally - Joint property ownership: Change from tenants in common to joint tenants - GOV.UK
    Whether you use a conveyancer or not is entirely up to you and most decide after they have read PG 1

    we are buying a property that when the completion checks on land registry were done, came back with the following:

    An application to register an agreed notice in favour of LC Asset 2 S.a r.l.. was lodged for registration on 30 September 2024 at 13:36:38 but HM Land Registry is not yet in a position to approve it and complete the registration by entry in the register. Nevertheless the pending application has priority over the disposition protected by this result.

    it has been 4 weeks now since we found out about the above and our solicitor says we can’t move forward until it is dealt with by Land registry and the sellers solicitor just keep saying that they are waiting to hear. Is there anything we can do to expedite the process? Everyone in the chain is ready we are just waiting on this one issue. The title number is WSX119245.

    The application you are referring to was completed on the 3rd Dec and the register updated

    Thank you for responding so quickly. Do you know how long something like this can take in order to exchange and complete on our sale? Now it is an agreed notice, does it need to come off before we can exchange and complete and if so - how long does that process normally take? Thanks so much

    Thank you for responding so quickly. Do you know how long something like this can take in order to exchange and complete on our sale? Now it is an agreed notice, does it need to come off before we can exchange and complete and if so - how long does that process normally take? Thanks so much 
    Timescales will vary re exchange/completion but they are all down to the conveyancers involved.
    A buyer is very unlikely to complete until the Agreed Notice is dealt with in some way such as settled/removed

    Eighth Anniversary First Post Combo Breaker
    The transfer deeds for completing the purchase of my house on 7 June 2024 were submitted to the Land Registry on 13 June 2024. It's now been 207 days, and I still don't have proof I own my home and is causing issues as I can't raise finance for essential works until it has bee processed.

    Can you please look into processing my application asap?

    If there's an urgency re getting the application processed then your conveyancer/you should request expedition - Request an expedite - GOV.UK
    The delay to date has been down to the fact that there was a prior application lodged to register another transfer out of a much larger title owned by the Council.

    We're looking to obtain the: 

    Official copy of Title Register Entries.
    Title Plan relating to our property. 

    and were thinking of using form OC1. Do you know whether this would be the correct form and would £22 (for one copy of each) be the correct ammount?  

    We were wondering if it would be possible to know roughly how long it usually takes to return the docuements as well, please (although we completely understand any timeline would be an estimate and not binding!).  

    Really apprecaite your help and sorry if this has already been answered elsewhere.

    If you want official copies then form OC1 and £11 for each is correct. You can apply for both using the one form and a combined fee
    Processing times are generally 24/48 hrs at our end so all about the postal service both to and from as well. 
    In my experience if you applied today then odds are you would receive the OCs around 27th Jan.
