Hi all,
Need urgent advice
We bought our new build house 3 years ago and we are now selling. We accepted the offer on 25th Jan and we’re currently on hold due to an issue with the plans for the property.The solicitors we bought the property with have been trying to sort this out for the past 3 years and we had no idea. We’ve been told that the issue is that land registry wont accept the plans because they don’t match up. I don’t fully understand what that means but our solicitors have been going back and forth between Wainhomes’ solicitors and land registry. Land registry have said they need the sellers solicitors (wainhomes) to draw up new plans for the building and get that over to them. Which will then be expedited and take up to 10 days. So this is what we’re waiting for.
We received the memorandum of sale on the 8th Feb and I sent this straight over to my solicitors for them to expedite the case but Wainhomes are taking forever to get this done and have also not been in contact with my solicitors since 20th Feb.
Im currently in contact with Wainhomes customer care to try to chase this.
So my questions - how long should it take for them to come up with these plans? Is this something that happens regularly? Is it common with new builds? What can we do to get this moving quicker? Also my current solicitors that im selling with (different to the ones I bought with) say they cant do anything until this is resolved and have put my case on hold. Is there really nothing else they can be doing? So that when this is actually expedited to land registry and all is okay, there is less to do after. It seems pointless to wait until it is done because its taking far longer than I thought it would.

- Land registry rejected original new build plans. (After we had bought and moved in)
- Wainhomes’ solicitors have to create new plans
- They haven’t communicated with us since 20th Feb
- We are in the process selling this property and this has put our case on hold
- Main question: How long should this take and can we do anything to speed this up?0 -

We are in the process of buying a property that would be needing a lot of work done before moving in, and the end of our tenancy agreement is fast approaching. We have our mortgage offer 13th February. Its only now when our solicitor are requesting documents from vendors solicitors that we have been made aware by the EA that the vendor made a first registration application May 2023, and that this have now just been expedited. Is it possible to check the status of the application to LR with any other information but the application reference? If yes, what could this be
We really are worried there wouldn't be enough time to carry out the works needed for us to move in by the end of our tenancy

It does happen but not regularly. And yes it’s most likely to happen with new builds as the developer may deviate from what’s been agreed/surveyed etc
Theres nothing your new solicitor can do. We are all in the hands of the developer.

We really truly only wanted the 1year tenancy at this new place to enable us buy our own place and move into, but things didn't quite went as quickly as we had hoped. And now we have this property that's reportedly been in the vendors family since the 1940s, that we really love, and have gotten a mortgage offer for, only to find out now that it's among the 15% or so unregistered properties in the UK. We really hope this gets sorted soon

hello @Land_Registry. my flat had a deed of surrender and regrant (leasehold). registered with land registry in 2023. i am now selling my flat and we were close to exchanging contracts, but have discovered the application is still pending with land registry, so can’t move forward. my solicitor advised they did expedite but we are waiting to hear still. would you be able to help and see if anything is holding up the application? many thanks.0
