    Hi @Land_Registry sorry I'm phrasing this question in rather vague terms, mainly because of threats and actual assaults I'm reluctant to give away too much identifying detail.
    The very large garden of an old house due for demolition has been partly split as the owner has built houses, about 8 planned in total. 
    My house was sold about 8 years ago and separated from the main plot by TR1 and a second house followed a few years later. 
    Another house has been tenanted but there is no separate Land Reg entry for it and the house is mortgaged quoting the original land plot and house.
    Is there a requirement for the tenanted house to be split and registered separately from the original plot other than a transfer to an new owner or co-owner? 
    Technically the new house is still in the original ownership but there is now a buy-to-let mortgage in favour of the owner's limited company.
    I've been checking for a separate registered title for a few months, but there's no entry for the new address.  I am looking into general fishiness but possibly I'm barking up the wrong tree.  I'm particularly interested in any new covenants for the new plot to see if they mirror those of my own house.     No such requirement but the details as shared don’t add up/make sense re a registered scenario I’m afraid. 
    A TR1 (transfer of whole) wouldn’t separate a house from a larger plot. 
    Highly unusual for a part of a title to be mortgaged in the way you describe 
    I’d suggest a DM with the specific details and Qs so I can look at what’s registered and how.
    If you don’t want to share then I’d recommend seeking legal advice to identify any fishiness

    We are in the process of buying a property. The person on the title deed is deceased. The grant have probate is back and the spelling of the deceased owner's middle name is not correct.

    Does this need to be corrected before we exchange and complete or can we do so and our solicitor sends a statement of truth regarding the name error with our application to transfer ownership?

    When you exchange and complete is not our call. 
    If you do complete and submit the probate and a statement of truth re the name/them being one and the same person then we will consider the application as a whole and on merit. 
    It’s your solicitor who needs to decide if they can accept the evidence being provided

    OK I am still trying with these forms. Land_registry I have read pages you suggest and watched the video but the video deals with someone putting something into joint names and not everything on it applies.  I know this isn't your fault or problem but I just think this should be so much easier for people to do when someone dies, as the price the solicitors want to charge is so expensive  :'( (rant over......sorry this is more to myself than directed at anyone else)

    So TR1 Box 4 the transferors.  Do I include my husbands name on there even though he has passed away because that is the name currently held on the land registry records. Do I put deceased in brackets afterwards? Or will they realise this because I am sending the grant of probate with the forms?

    Just out of interest what happens if you fill the forms in wrongly? Do they just send them back to you to correct?

    Understood and appreciated although you are transferring into joint names so you can still apply the basics to the forms/process. 
    The transferors are the people who can legally transfer the title. That wouldn’t include your late husband sadly. 
    You posted that the field was registered in the joint names of your late husband and the two cousins. You’ll recall that the legal ownership has passed to the two cousins so they are the ones who would transfer it. So they are the Transferors. 
    The probate/death certificate for your late husband confirms his death and why he is not a transferor/party to the transfer deed

  • Hi, we bought a property at the end of September 2022. This was for a property being part-exchanged for a new build. The property is freehold. The property is currently in the names of the developers on land registry. 

     We have been told by our solicitors that an application to the land registry to transfer the property in our names was put in when we bought the property. We have now received a letter from our mortgage lender telling us that the property had not yet been registered on land registry with their charge on it.


    Is it expected that the application should take this long? The title number is LT364773.

    Timescales are stretched so can wait this long. Your purchase is protected so if there’s no urgency then simply bear with us and wait for your conveyancer to confirm when registered. 
    The application was submitted in Nov and processed at end of April. But we couldn’t complete it and contacted the conveyancer. No reply as yet so please contact them to confirm details and their own timescales. 
    If they have no record of that contact then they need to get in touch direct
